我国法治政府建构研究

【摘要】：法治政府是转型期中国所选择并正处于建构过程中的政府模式。古希腊法治思想、儒家思想、宪政理念、马克思主义法治学说以及西方公共行政理论等是我国建构法治政府的重要理论基石。我国建构法治政府将对社会主义市场经济、中国共产党的执政地位、服务型政府建设以及和谐社会的实现等都将产生积极的影响。法治政府从理论到实践在中国已经历了理论准备期、目标确立期和模式转型期。通过对我国法治政府建构历程的回顾与反思,将我国建构法治政府的实质归结为利益的均衡配置、权利与权力的平衡以及公民与政府的和谐等三个方面。可以说,这不仅是我国法治政府建构的关键因素,也是我国法治政府建成与否的重要理论标准。当前,我国法治政府建构中存在的主要问题有:官本位思想严重、法律体系不完善、政府信息公开难、行政监督形式化、权利受权力压制等。实践中的问题仍需要从理论研讨中求解。通过对建构法治政府三种动力模式,即政府主导型、公民推动型和良性互动性的分析,进而得出我国应建立良性互动型的法治政府模式。最后,从全球性“政府再造”运动、社会主义市场经济发展、社会主义国家人民当家做主的本质、宪法保证以及高层领导集团的态度等方面进行可行性论证,并分析了我国建构良性互动型法治政府的前提条件,最终推导出我国建构良性互动型法治政府的具体思路和路径设计。
[Abstract]:The rule of law government is the government mode chosen by China in the transition period and is in the process of construction.The rule of law in ancient Greece, Confucianism, constitutional ideas, Marxist theory of the rule of law and western public administration theory are the important theoretical cornerstone of the construction of the rule of law government in China.The construction of a government ruled by law in China will have a positive impact on the socialist market economy, the ruling position of the Communist Party of China, the construction of a service-oriented government and the realization of a harmonious society.From theory to practice, the rule of law government has gone through the period of theoretical preparation, target establishment and mode transformation in China.By reviewing and reflecting on the construction of our country's government ruled by law, the essence of the construction of the government ruled by law in our country is reduced to three aspects: the balanced allocation of interests, the balance of rights and power, and the harmony between citizens and government.It can be said that this is not only the key factor in the construction of our country's rule of law government, but also the important theoretical standard of our country's rule of law government.At present, the main problems in the construction of the government ruled by law in our country are as follows: the official standard thought is serious, the legal system is not perfect, the government information is difficult to open, the administrative supervision is formalized, the right is suppressed by the power, and so on.Practical problems still need to be solved from theoretical research.Through the analysis of the three driving modes of constructing the government by law, that is, government leading type, citizen pushing type and benign interaction mode, the author concludes that China should establish a benign interactive government model of rule of law.Finally, from the global "government reconstruction" movement, the development of the socialist market economy, the nature of the people of socialist countries as masters, the constitutional guarantee and the attitude of the high-level leading groups, etc.It also analyzes the precondition of constructing a benign interactive rule of law government in our country, and finally deduces the concrete thinking and path design of constructing a benign interactive rule of law government in our country.
