以法制保障网络空间安全构筑网络强国——《网络安全法》和《国家网络空间安全战略》解读

【摘要】：2016年11月7日上午,十二届全国人大常委会第二十四次会议表决,正式通过了《中华人民共和国网络安全法》,将于2017年6月1日起施行。该法进一步界定了关键信息基础设施范围,对攻击、破坏我国关键信息基础设施的境外组织和个人规定了相应的惩治措施,增加了惩治网络诈骗等新型网络违法犯罪活动的规定等。2016年12月27日,《国家网络空间安全战略》发布,作为我国首次发布的关于网络空间安全的战略性纲要文件,该战略不仅阐明了中国关于网络空间发展和安全的重大立场和主张,更明确了若干年内的战略方针和主要任务,可概括为"坚定捍卫网络空间主权、坚决维护国家安全、保护关键信息基础设施、加强网络文化建设、打击网络恐怖和违法犯罪、完善网络治理体系、夯实网络安全基础、提升网络空间防护能力、强化网络空间国际合作"等九个方面。"一法一战略"相辅相成,从法律层面保障我国网络空间安全,促进我国从网络大国到网络强国的演变,在全球网络空间治理中发挥中国的积极作用。特邀相关专家学者,从不同角度就《网络安全法》和《国家网络空间安全战略》的发布做解读。
[Abstract]:On the morning of November 7, 2016, the 24th meeting of the standing Committee of the Twelfth National people's Congress voted to formally adopt the Law of the people's Republic of China on Cybersecurity, which will come into effect on June 1, 2017. The law further defines the scope of the critical information infrastructure and provides appropriate penalties for foreign organizations and individuals who attack and destroy the key information infrastructure in China. The provisions on punishing new types of cyber illegal and criminal activities, such as cyber fraud, were added. On December 27, 2016, the National Cyberspace Security Strategy was issued as the first strategic outline document on cyberspace security in China. The strategy not only clarifies China's major position and stand on the development and security of cyberspace, but also clarifies the strategic guidelines and main tasks for a number of years, which can be summarized as "firmly safeguarding the sovereignty of cyberspace and resolutely safeguarding national security". To protect key information infrastructure, to strengthen the construction of network culture, to crack down on cyberterror and crimes, to improve the network governance system, to consolidate the foundation of network security, and to enhance the ability of cyberspace protection. Strengthen international cooperation in cyberspace "and other nine aspects." "one law and one strategy" complement each other, safeguard our country's cyberspace security from the legal level, promote the evolution of our country from the network big country to the network powerful country, and play a positive role in the global cyberspace governance. Specially invited experts and scholars from different angles to interpret the release of the Cybersecurity Law and the National Cyberspace Security Strategy.
