全面依法治国背景下的大学生法制教育研究

【摘要】：党的十八届四中全会通过了《中共中央关于全面推进依法治国若干重大问题的决定》,提出全面推进依法治国重大战略。全面推进依法治国,是以习近平同志为核心的党中央协调推进“四个全面”治国理政战略思想的重要组成部分。全面推进依法治国要求“科学立法、严格执法、公正司法、全民守法”,将中国法治建设推向新高度。大学生作为国家精英、社会栋梁,在推进全面依法治国的历史进程中担当着重要的历史使命。在全面依法治国背景下,准确评判我国大学生法制教育的现状,分析法制教育取得的成绩、存在的不足,研究全面依法治国战略提出对大学生法制教育的新机遇、新挑战,并提出全面推进依法治国背景下改进大学生法制教育的策略、方式、方法,对提高大学生法制教育实效具有重要的理论意义和深远的现实意义。论文分五个部分:第一部分是绪论,阐明了选题背景和研究意义,对国内外相关研究进行了综述,提出了本文的研究思路、研究方法、创新点和存在的不足。第二部分是概念界定和本文研究的理论基础。本文涉及到的基本概念包括“全面依法治国”、“法制”、“法治”、“大学生法制教育”等。“马克思主义的法制教育理论”、“人的自我需求理论”、“以人为本理论”等为本文研究奠定了理论基础。第三部分回顾了改革开放以来我国大学生法制教育的历程和取得的成就,分析了全面依法治国战略提出后对大学生法制教育提出的新的价值导向。改革开放以来,我国大学生法制教育从无到有,从零散到系统取得了举国公认的成就,为建设法治中国起到了重要作用。但是推进全面依法治国战略又为高校法制教育提出了全新的要求,大学生对法制教育的诉求更加迫切,社会应更加注重对大学生法制教育的权威塑造。第四部分论述了全面依法治国背景下大学生法制教育面临的新挑战。目前我国社会环境还不能完全适应全面依法治国背景下大学生法制教育的新形势;高校法制教育现状还不能完全满足全面依法治国的新要求;大学生的法制素养、法律知识、法制思维、守法用法能力及法制行为方式等与全面推进依法治国还存在一定差距。这些挑战来自于社会、学校和大学生自身。第五部分提出了全面依法治国背景下完善大学生法制教育的对策建议。对照全面依法治国的新要求,立足当前大学生法制教育整体现状,从社会、高校及大学生自身提出了优化和改进大学生法制教育的途径、方式、方法、策略,以及提高大学生法制教育实效性的几点建议。
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee adopted the "decision of the CPC Central Committee on comprehensively promoting governing the country according to Law," and put forward a major strategy for comprehensively promoting the rule of law. To advance the rule of law in an all-round way is an important part of the Party Central Committee, which regards Comrade Xi Jinping as the core. To advance the rule of law in an all-round way requires "scientific legislation, strict law enforcement, fair administration of justice, and law-abiding by the whole people", which will push the construction of China's rule of law to a new height. As the elite of the country and the pillars of the society, college students are playing an important historical mission in the historical process of promoting the rule of law in an all-round way. Under the background of ruling the country according to law, the present situation of the legal education of college students in our country is judged accurately, the achievements and shortcomings of the legal education are analyzed, and the new opportunities and challenges for the legal education of college students are put forward by studying the strategy of governing the country according to the law in an all-round way. It also puts forward the strategies, ways and methods of improving the legal education of college students under the background of governing the country according to law, which has important theoretical and far-reaching practical significance for improving the effectiveness of the legal education of college students. The paper is divided into five parts: the first part is the introduction, which clarifies the background and significance of the topic, summarizes the related research at home and abroad, and puts forward the research ideas, research methods, innovation points and shortcomings of this paper. The second part is the definition of the concept and the theoretical basis of this study. The basic concepts involved in this paper include "overall rule of law", "legal system", "rule of law", "college students' legal education" and so on. The Marxist theory of legal education, the theory of human self-demand and the theory of people-oriented have laid a theoretical foundation for the study of this paper. The third part reviews the history and achievements of the legal education of college students since the reform and opening up, and analyzes the new value orientation for the legal education of college students after the overall strategy of governing the country according to law is put forward. Since the reform and opening up, the legal education of college students in our country has made the universally recognized achievements from scratch, from scattered to systematic, and has played an important role in the construction of China under the rule of law. However, the promotion of comprehensive rule of law strategy has put forward a new requirement for the legal education in colleges and universities. The demands of college students for legal education are more urgent, and the society should pay more attention to shaping the authority of the legal education of college students. The fourth part discusses the new challenges facing the legal education of college students under the background of governing the country according to law. At present, the social environment of our country cannot fully adapt to the new situation of legal education for college students under the background of comprehensive rule of law; the present situation of legal education in colleges and universities cannot fully meet the new requirements of governing the country according to law; the legal literacy and legal knowledge of college students, There is still a certain gap between legal thinking, law-abiding ability and legal behavior. These challenges come from society, schools and college students themselves. The fifth part puts forward the countermeasures and suggestions to perfect the legal education of college students under the background of ruling the country according to law. According to the new requirements of ruling the country according to the law, based on the present situation of the legal education of college students, this paper puts forward the ways, methods, strategies to optimize and improve the legal education of college students from the society, universities and college students themselves. Some suggestions on how to improve the effectiveness of legal education for college students are also given.
