论农村法律文化的培育

【摘要】：单纯的法律制度解决不了农民的法律信仰问题,而文化层面的法律具有潜移默化的功能。传统法律文化对农村法治建设的影响表现为重礼轻法观念导致的纠纷依法调处南、重权轻法观念导致的民主法制进程滞后、重刑轻民观念导致的法律亲和力低。本文从培育农村法律文化应挖掘传统文化,培育现代法治理念;扎实推进普法,增强农民法律意识;改善执法司法,增强农民对法律的信任等方面对农村法律文化的培育进行了论述。
[Abstract]:The simple legal system can not solve the problem of farmers' legal belief, but the culture level law has the function of imperceptible. The influence of traditional legal culture on the construction of rural rule of law shows that disputes caused by the concept of attaching importance to propriety and ignoring law are dealt with in accordance with the law, the process of democracy and legal system caused by the concept of attaching importance to power over law is lagging behind, and the legal affinity caused by the concept of heavy punishment over the people is low. In this paper, we should excavate the traditional culture, cultivate the concept of modern rule of law, promote the popularization of law, strengthen the legal consciousness of farmers, improve the law enforcement and judicature. This paper discusses the cultivation of rural legal culture in the aspects of strengthening farmers' trust in law.
