社会主义和谐社会与竞争法制建设研究

【摘要】： 目前,我国学术界关于“社会主义和谐社会与经济法”的相关理论研究已经硕果累累,但“社会主义和谐社会与竞争法”的理论研究还相对缺乏。本文试图通过设置社会主义和谐社会这个前提环境,以“和谐”这个特殊的视角引入“竞争”,论证“竞争法”与社会主义和谐社会的关系,强调其在社会主义和谐社会的构建中所起的重要作用,从而提出在构建社会主义和谐社会之中如何更好地进行竞争法制建设。本文的主要研究重心有二:首先,“和谐”与“竞争”看起来是不能相容的,如何将“和谐与竞争”融合并将其上升到新的高度,这是需要科学的转换和论证的;其次,竞争法作为矫正市场与政府的双重失灵的保障机制,应不断完善其体制以适应社会发展的需要。但是,如何在社会主义和谐社会的背景之下多角度、深层次构建我国竞争法,从而实现“和谐”的发展目标,需要考虑更多的因素。本文以社会主义和谐社会作为出发点,以党的十七大提出的“民主法治”为契机,从“和谐”这个特殊的视角引入竞争法,阐述了在社会主义和谐社会背景之下如何进行竞争法制建设。主要研究思路如下: 第一,通过对社会主义和谐社会中竞争的研究,以及对竞争环境下社会和谐构建方面的分析,论证了社会主义和谐社会建设中和谐与竞争的辩证统一。第二,从社会主义和谐社会与法治入手,进而到社会主义和谐社会与经济法,并最终通过社会主义和谐社会与竞争法的分析,充分阐述了“竞争”在社会主义和谐社会的建设中所产生的影响,以及竞争法在构建社会主义和谐社会中所发挥的作用。第三,通过建立“和谐与竞争”作为新的结合点,站在一个全新的角度和高度,研究社会主义和谐社会背景之下我国竞争法制的建设思路,并首次从竞争文化、竞争立法以及竞争执法三个角度论证了如何在社会主义和谐社会中加强竞争法制建设。党的十七大已明确提出,要建立“民主法治”的社会主义和谐社会。在社会经济建设中,竞争法具有直接的调节作用。在国际竞争的大环境下,我国需要快速健康稳定的经济发展,也必然需要配套合理的竞争法作为调节和保障。研究我国的竞争法制建设,对于完善我国的竞争法体系、保护经营者和广大消费者以及促进有效竞争是非常必要的。同时,它也为我国社会主义和谐社会的构建起到了推动作用。
[Abstract]:At present, the theoretical research on "Socialist harmonious Society and Economic Law" in Chinese academic circles has been fruitful, but the theoretical study of "Socialist harmonious Society and Competition Law" is still relatively lacking. By setting up the prerequisite environment of socialist harmonious society and introducing "competition" from a special angle of view of "harmony", this paper tries to demonstrate the relationship between competition law and socialist harmonious society. It emphasizes the important role it plays in the construction of the socialist harmonious society, and puts forward how to better build the competitive legal system in the construction of the socialist harmonious society. The main research focus of this paper is twofold: first, "harmony" and "competition" seem incompatible, how to merge "harmony and competition" and raise them to a new height, which needs scientific transformation and argumentation; Competition law, as a safeguard mechanism to correct the double failure of market and government, should constantly perfect its system to meet the needs of social development. However, under the background of socialist harmonious society, how to construct the competition law of our country deeply and realize the development goal of "harmony", we need to consider more factors. Taking the socialist harmonious society as the starting point, taking the "democratic rule of law" put forward by the 17th National Congress of the Party as the turning point, this paper introduces the competition law from the special angle of "harmony". This paper expounds how to construct the legal system of competition under the background of socialist harmonious society. The main research ideas are as follows: First, through the study of competition in the socialist harmonious society and the analysis of the construction of the social harmony in the competitive environment, the dialectical unity of harmony and competition in the construction of the socialist harmonious society is demonstrated. Second, from the socialist harmonious society and the rule of law, and then to the socialist harmonious society and economic law, and finally through the analysis of the socialist harmonious society and competition law. The influence of "competition" in the construction of socialist harmonious society and the role of competition law in the construction of socialist harmonious society are fully expounded. Third, through the establishment of "harmony and competition" as a new combination point, standing at a new angle and height, this paper studies the construction ideas of our country's competition legal system under the background of socialist harmonious society, and for the first time, from the competition culture, This paper demonstrates how to strengthen the construction of competition legal system in the socialist harmonious society from the three angles of competition legislation and competition law enforcement. The 17th National Congress of the Party has clearly proposed to establish a socialist harmonious society of "democracy and rule by law". In the social economy construction, the competition law has the direct adjustment function. Under the environment of international competition, our country needs rapid, healthy and stable economic development, and must also need reasonable competition law as adjustment and guarantee. It is necessary to study the legal construction of competition in order to perfect the competition law system, protect the operators and consumers and promote the effective competition. At the same time, it also played a role in promoting the construction of a harmonious socialist society in China.
