法治社会指数:评价主体与指标体系

【摘要】：法治社会指数是衡量法治社会建设水平的量化参数。在法治社会评价体系中,评价主体影响评价的公信力,指标体系决定评价的科学性。基于法治的价值导向及其不易测量的技术属性,评价主体与指标体系存在密切关系。借鉴境外的做法,服务于评价目的,构建主观评价与客观评价相结合、专家评议与公众满意度相匹配的指标体系具有科学依据及操作上的可行性。现实条件下,由人大或法学会作为评价主体,政法部门协助,委托第三方独立实施是法治社会评价较为理想的模式,评价维度指向科学立法、依法行政、司法公正和全民守法。同时,应开放评价权,推进独立第三方评价,扩大公众参与。
[Abstract]:The social index of rule by law is a quantitative parameter to measure the level of construction of society ruled by law. In the evaluation system of the society ruled by law, the credibility of the evaluation subject and the scientific nature of the evaluation are determined by the index system. Based on the value orientation of the rule of law and its difficult to measure the technical attribute, the evaluation subject has a close relationship with the index system. Using overseas practice for reference, serving the purpose of evaluation, constructing the index system of combining subjective evaluation with objective evaluation and matching expert evaluation with public satisfaction has scientific basis and operational feasibility. Under the realistic conditions, it is an ideal mode to evaluate the rule of law society by the people's Congress or the Law Society as the evaluation subject, with the help of the political and legal departments, and to entrust the third party to implement independently. The evaluation dimension points to scientific legislation, administration by law, judicial justice and law-abiding by the whole people. At the same time, we should open the right to evaluation, promote independent third-party evaluation, and expand public participation.
