新生代农民工的法制教育研究

【摘要】：改革开放三十多年来,中国农村走出了新老两代农民工。目前,新生代农民工数量接近1亿,已经成为农民工的主流群体。这一庞大群体对我国现代化和城市化的进程产生了深刻而巨大的影响。中央“一号文件”传递出党和政府对于新生代农民工的高度关注。加强新生代农民工的法制教育研究,切实解决农民工问题,对构建和谐社会,推动我国法治进程,建设社会主义法治国家,具有重要意义。本文通过问卷调查的实证研究方法,对新生代农民工的法制教育问题进行了相关研究,从以下几个方面进行了论述。引言部分,本文首先梳理农民工的发展历史,交代了新生代农民工产生的历史背景,以凸显新生代农民工的时代特色;其次,叙述了社会主义法制教育在思想政治教育中的重要作用,以及做好新生代农民工法制教育工作的重要意义;最后,本章节还对新生代农民工的法制教育研究现状做了概述,指出了本文的研究方法、研究目的、研究意义、和创新之处。本文分为四个部分:第一部分,界定了新生代农民工的内涵和特征。首先从农民工发展的历史入手,指出目前中国农民工正处于新老两代代际更替的时期,新生代农民工已经逐渐登上了时代发展的大舞台;其次,通过问卷调查的方法,一方面将新生代农民工和老一代农民工进行纵向比较,得出新生代农民较之老一代有着较高的受教育水平、较强的维权意识以及追求自由平等的自觉性;另一方面将新生代农民工和城市新生代进行横向比较,从而分析出,新生代农民工由于没有接受过高等教育,缺乏专业技能,羸弱的竞争力只允许他们进入非正规就业市场,由此他们过高的期望与非正规就业市场提供的低劣的城市生存条件,形成了巨大的落差。第二部分,论述了新生代农民工法制教育缺失的表现。本部分首先描述了我国从“一五”普法到“五五”普法的法制教育历程,指出在我国法制教育现状下,针对新生代农民工的法制教育还存在一些不足。然后详细列举了新生代农民工法制教育缺失的表现,具体为:法律知识匮乏、教育内容不合理及方法滞后。最后,指出了法制教育缺失所带来的正反两方面的后果:即新生代农民工权利受到侵害无法维护以及他们遵纪守法的意识不强。第三部分,从自身和外部两方面,分析了造成新生代农民工法制教育缺失的原因。其中,自身原因主要是新生代农民工自小受到农村宗法等级制度、司法行政合一、德主刑辅礼治的传统思想影响,对法律缺乏了解,加之他们在乡村中学接受义务教育时,并没有受到普法的恩泽,对法律更是知之甚少;外部原因主要是受重视程度不够、法制教育经费不足、教育工作落实不到位等。第四部分,根据问卷调查的数据分析,本文提出了一些关于增强新生代农民工法制教育的对策和建议,具体包括以下几个重要方面:一,加大相关立法力度;二,明确责任划分;三,合理设置法制教育内容,主要包括改变以往对农民工重义务轻权利及重实体轻程序的教育模式;四,全方位多渠道进行普法教育,将法制教育与职业技能培训和法律服务结合起来;五,改革法制教育的方法,实现法制教育信息化和网络化。结论:总结全文,点明加强新生代农民工法制教育的重要意义,并简要说明笔者写这篇文章的初衷。
[Abstract]:With the reform and opening - up for more than 30 years , China ' s rural migrant workers have come out of the new and old peasant workers . At present , the number of migrant workers in the new generation is close to 100 million , which has become the mainstream group of migrant workers .

This paper studies the legal education of the new generation migrant workers through the empirical research method of the questionnaire , and discusses them from the following aspects .

In the introduction part , this paper first sorts out the development history of the migrant workers and the historical background of the new generation of migrant workers , which highlights the important role of the socialist legal education in the ideological and political education , and also gives an overview of the present situation of the legal education of the new generation migrant workers , and points out the research methods , research purposes , research significance and innovation .

This paper is divided into four parts : the first part , defines the connotation and characteristics of the new generation migrant workers . First of all , from the history of the development of migrant workers , it is pointed out that the new generation of migrant workers has gradually reached the stage of the development of the times .

The second part discusses the lack of legal education in the new generation migrant workers . This part firstly describes the legal education course of the new generation migrant workers from the " one - five " method to the five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five - five -

The fourth part , according to the data analysis of the questionnaire , puts forward some countermeasures and suggestions on strengthening the legal education of migrant workers in the new generation .

Conclusion : To sum up the whole text , point out the importance of strengthening the legal education of new generation migrant workers , and briefly explain the author ' s original intention to write this article .
