隐性采访之法治成本分析

【摘要】：隐性采访是指以偷拍偷录为主要拍摄手段的众多新闻采访方式中的一种,它通过非常规的手段获得常规手段难以挖掘的新闻素材受到媒体和受众的追捧,近年来一直活跃在民众的媒体生活中。隐性采访的法治成本研究在当前的社会历史条件下十分必要并且具有可行性。事实上,隐性采访“高人气”的背后也隐藏了严肃的社会和法律问题,比如引起了一系列新闻侵权诉讼,引发了社会的诚信危机等。本文将隐性采访这一当下备受争议的新闻现象从法学和经济学结合的角度进行探析,通过对隐性采访法治成本的考量,提出隐性采访走向法治化的一些构想,以期为隐性采访探求一条公平与效率兼顾的法治路径。首先考量隐性采访的静态法治成本,主要包括隐性采访的立法成本和法律实施成本。其中立法成本包括立法自身工作成本以及立法的社会成本；法律实施成本则包括执法成本、司法成本以及守法成本。其次考量隐性采访在实践中的法治成本,主要是指在多年的实践中面临的公正流失,观念失衡等问题,包括隐性采访在追求实体正义的过程中与程序正义产生的矛盾；隐性采访给新闻行业及受众带来的效益和实践中产生的负面效应；隐性采访在实践中对社会发展造成的影响。最后,提出隐性采访的法治构想,包括《记者法》立法路径的选择以及具体的立法规制,即采访权属性的规制、采访启动的规制、采访内容及手段的规制。
[Abstract]:Recessive interview refers to one of the many methods of news interview, which is mainly used to shoot secretly and secretly. It is sought after by the media and the audience through unconventional means to obtain news material that is difficult to excavate by conventional means. In recent years has been active in the mass media life. It is necessary and feasible to study the legal cost of recessive interview under the current social and historical conditions. In fact, the hidden interview "high popularity" also hides serious social and legal problems, such as a series of news tort litigation, triggered a social integrity crisis and so on. This paper analyzes the recessive interview, a controversial news phenomenon, from the angle of the combination of law and economics, and through the consideration of the cost of the rule of law of the recessive interview, puts forward some ideas of the recessive interview moving towards the rule of law. In order to explore a recessive interview, a fair and efficient way to rule by law. Firstly, the static cost of rule of law is considered, including the cost of legislation and the cost of law enforcement. The cost of legislation includes the cost of legislation itself and the social cost of legislation, while the cost of law enforcement includes the cost of law enforcement, the cost of judicature and the cost of abiding by the law. Secondly, considering the cost of the rule of law in the practice of recessive interview, mainly refers to the problems such as the loss of justice and the imbalance of concept in the practice for many years, including the contradiction between the hidden interview and the procedural justice in the process of pursuing substantive justice; The benefit of recessive interview to news industry and audience and the negative effect in practice, and the influence of recessive interview on social development in practice. Finally, the author puts forward the idea of the rule of law of the recessive interview, including the choice of the legislative path and the specific legislative regulation, that is, the regulation of the attribute of the right to interview, the regulation of the initiation of the interview, the regulation of the content and means of the interview.
