韩非子法治思想研究及其当代价值

【摘要】:韩非,又称韩非子,战国末期著名的法家代表人物,法家思想的集大成者。法家思想起源于春秋时期,形成于战国年代,在秦朝达到鼎盛,秦朝灭亡之后走向衰落。法家思想代表当时新兴地主阶级利益,以主张“以法治国”为核心思想的一个学派。法家的先驱人物有春秋时期的管仲、子产,战国时代的李悝、吴起、商鞅、申不害、慎到等人。法家思想体系的最终确立是由韩非子完成的,他综合与总结了前期法家所得成就,创立了以法为本,“法”、“势”、“术”相结合的法治理论体系。他的这一思想为秦朝一统天下提供了理论支持,对后世影响深远。借鉴吸收韩非子法治思想中合理的成分,对于当今社会建立以法治国方略具有十分重要的意义。本文将从三个方面解析这位法家代表人物的法治思想,并重点对有利于当代的思想进行研究。 第一部份韩非法治思想概述。该部分首先从介绍法家思想的基本内容着手,到解析韩非子出生的时代背景,学术背景及他的法治思想内容;其次,全面论述了韩非子的以法治国思想。 第二部份韩非法治思想对中国传统法律文化的影响。该部分主要从维护君权,注重义务而非权利以及对忌讼文化形成等方面论述了韩非法治思想对中国法律文化的具体影响。该部分还简要评析了韩非法治思想的历史局限。 第三部份韩非法治思想的当代价值。该部分首先以韩非的视角来看待了目前中国法治建设面临的诸多难题。比如资源分配不公,社会道德溃败,选择性执法等等。其次,提取韩非法治思想中有益的元素作为当今法治建设的参考,比如治理腐败,重刑止奸,树立法律权威等等。
[Abstract]:Han Fei, also known as Han Feizi, was a famous representative of Legalists in the late warring States period. Legalism originated in the Spring and Autumn period, formed in the warring States period, reached its peak in the Qin Dynasty, and then declined after the Qin Dynasty perished. The Legalist thought represented the interests of the new landlord class at that time, and a school of thought which advocated "governing the country by law". The pioneers of the Legalists were Guan Zhong and Zi Chin in the Spring and Autumn period, Li Kui in the warring States period, Wu Qi, Shang Yang, Shen carelessly and others. Han Feizi completed the final establishment of the Legalist thought system. He synthesized and summarized the previous achievements of the Legalists, and established a legal theory system based on the law, "law", "power" and "skill". His thought provided theoretical support for Qin Dynasty to dominate the world, and had a profound influence on later generations. It is of great significance to draw on the reasonable elements of Han Feizi's thought of rule of law for the establishment of the strategy of ruling the country by law in today's society. This paper will analyze the Legalist's thought of rule of law from three aspects, and focus on the thoughts that are beneficial to the present. The first part is an overview of Han Fei's thought of rule of law. This part begins with the introduction of the basic content of Legalist thought to the analysis of the background of Han Feizi's birth, academic background and his thought of rule by law; secondly, it comprehensively discusses Han Feizi's thought of governing the country by law. The second part is the influence of Han Fei's thought of rule of law on Chinese traditional legal culture. This part mainly discusses the concrete influence of Han Fei's rule of law thought on Chinese legal culture from the aspects of safeguarding monarchy, paying attention to obligation rather than right and forming the culture of taboo litigation. This part also briefly comments on the historical limitations of Han Fei's thought of rule of law. The third part is the contemporary value of Han Fei's thought of rule of law. This part first looks at the problems in the construction of the rule of law in China from the perspective of Han Fei. Such as unfair distribution of resources, social moral debacle, selective law enforcement and so on. Secondly, the beneficial elements in Han Fei's thought of rule of law are taken as the reference of the construction of the rule of law, such as controlling corruption, imposing severe punishment and preventing adultery, setting up legal authority and so on.
