法制政府建设视野下依据“三定”方案制定档案行政权力清单的缘由及趋势——兼与吴雁平商榷

【摘要】："三定"方案,在权力清单制度建立过程中,与法律法规一道被视为档案行政权力的依据。依据"三定"方案制定档案行政权力清单的缘由是我国行政组织法律体系的不完备。充实、修改、完善现有行政组织法律法规,将"推进机构、职能、权限、程序、责任法定化"是建设法制政府的必然趋势。
[Abstract]:In the process of establishing the power list system, the "three definite" scheme, together with laws and regulations, is regarded as the basis of the administrative power of archives. The reason for making the list of administrative powers of archives according to the "three definite" scheme is that the legal system of administrative organizations in our country is incomplete. To enrich, modify and perfect the existing laws and regulations of administrative organizations and to "promote the legal system, function, authority, procedure and responsibility" is an inevitable trend in the construction of a legal government.
