我国住房租赁制度改革的时代选择及法制革新

【摘要】:住房市场的平稳健康发展是事关我国经济发展和社会稳定的大问题。自1978年推行住房商品化改革以来,我国经过30多年的努力,逐步构建起以所有关系为核心的住房体制。当前这种"购主租辅"的住房体制面临正着土地供应不足、市场发展过热、住房自有率畸高等体制性问题。2016年两会期间,中国政府提出要推动住房租赁制度改革,构建"购租并举"的住房新体制。住房租赁制度改革成为了推动我国住房体制改革的重要切入点。当前改革应当提高住房租赁市场的层次定位,调整住房租赁市场是住房交易市场二级市场的基本定位;转变住房租赁市场"二元制"的发展格局,矫正商品型市场与保障型市场隔离发展的现状;改变"所有权中心主义"的民法秩序,稳定不动产资源占有和用益关系,促进社会住房资源的物尽其用。
[Abstract]:The stable and healthy development of the housing market is a major issue affecting the economic development and social stability of our country. Since the implementation of the housing commercialization reform in 1978, after more than 30 years of efforts, China has gradually built up a housing system with all relations as the core. During the two sessions of.2016, the Chinese government proposed to promote the reform of the housing lease system and build a new housing system for the housing rental system. The reform of the housing leasing system has become an important entry point to promote the reform of the housing system in China. The reform of the housing lease should improve the level of the housing rental market. Adjusting the housing lease market is the basic position of the two level market in the housing market, changing the development pattern of the "two yuan system" in the housing lease market, correcting the current situation of the isolation and development of the commodity market and the guarantee market, changing the civil law order of the "ownership centralism", stabilizing the possession and usufruct of the real estate resources and promoting the social housing capital.
