农村基层治理公共性难题的法治化解

【摘要】：社会公共性衰微是当前农村基层治理的难点问题。立足于农村现代化转型的社会语境,现代法治得以进入农村公共性难题化解的实践场域,在"送法下乡"与"迎法下乡"的互动过程中确定其入场路径,于正式规则与非正式规则的交织融合中获得具体的入场形态。法治之于农村基层治理公共性难题化解的作用发挥,其基础在于法治本身的丰富功能,其操作则应着眼于农村社会主体公共性的制度构建、行为公共性的规范依据提供以及农村公共性实践的法律保障等方面。基于法治自身发展程度、法律的内在局限以及法律规范与农村其他社会规范相容程度等限制,法治之于农村基层治理公共性难题化解的作用发挥也存在不可忽视的边界。
[Abstract]:The decline of social publicity is a difficult problem in rural grassroots governance. Based on the social context of the rural modernization transformation, the modern rule of law can enter the practical field of resolving the rural public problems, and determine its entrance path in the interactive process of "sending the law to the countryside" and "welcoming the law to the countryside". In the formal rules and informal rules intertwined to obtain the specific admission pattern. The function of the rule of law in solving the problems of rural grass-roots governance is based on the rich function of the rule of law itself, and its operation should focus on the system construction of the public nature of the main body of the rural society. The normative basis of behavior publicity and the legal protection of rural public practice and so on. Based on the degree of development of the rule of law itself, the inherent limitations of the law and the compatibility of the legal norms with other social norms in rural areas, there is also a boundary that can not be ignored in the role of the rule of law in resolving the public problems of rural grass-roots governance.
