地方立法评估成果应用法治化问题与对策

【摘要】：在地方立法评估的基础上形成具有拘束力的地方立法评估成果,并确保该成果得以具体应用,具有重要价值。在地方立法评估成果应用方面,我国目前存在着相关的理论研究匮乏、没有明确的立法以及地方立法评估成果应用的保障机制阙如等诸多问题。为真正实现地方立法评估制度设置的宗旨,必须加强理论研究,以期为地方立法评估成果的应用提供智力支持,充实完善地方立法评估子制度,构建地方立法评估成果应用制度,建构地方立法评估成果报告的评价与奖惩机制,构建评估成果应用的问责机制,从而提升地方立法评估成果应用的法治化水准。
[Abstract]:Based on the evaluation of local legislation, it is of great value to form a binding assessment result of local legislation and to ensure its concrete application. In the application of local legislative evaluation results, there are many problems in our country, such as the lack of relevant theoretical research, the lack of clear legislation and the lack of a guarantee mechanism for the application of local legislative evaluation results. In order to realize the purpose of setting up the local legislative evaluation system, we must strengthen the theoretical research in order to provide intellectual support for the application of the local legislative evaluation results, and to enrich and perfect the local legislative evaluation sub-system. Constructing the application system of the local legislative evaluation results, constructing the evaluation and punishment mechanism of the local legislative evaluation results report, and constructing the accountability mechanism of the evaluation results application, so as to improve the rule of law level of the local legislative evaluation results application.
