法治政府建设的“中国特色”研究

【摘要】：法治政府建设是中国特色社会主义法治建设的核心内容之一。自2004年《全面推进依法行政实施纲要》颁布之后,关于中国特色社会主义法治政府建设问题的研究逐渐多起来,但大多都侧重于社会主义意识形态下法治政府涵义界定、具体特征及建设路径的研究,对“中国特色”的内涵界定及“中国特色”在法治政府建设实践中的具体体现还有待深入分析和探讨。研究法治政府建设的“中国特色”,即是从“中国特色”视角深入剖析中国法治政府建设的基本特征,探究“中国特色”在法治政府建设领域的具体体现。“中国特色”,是社会主义制度下的中国在政治、经济、文化等方面所具有的鲜明特征和独特属性,它不是简单地借鉴西方发达国家的建设经验,而是始终坚持与中国具体时代特征相结合,通过不断地深化改革,使社会主义的优越性、马克思主义的理论品质及中华民族优秀传统文化的特质更加突显。社会主义法治政府建设的“中国特色”具体体现在:其一,在理论依据上,始终以马克思主义,尤其是马克思主义法学思想为指导,对西方法治政府建设理论,则予以批判和借鉴;其二,在建设主体上,政府推动、民众参与、上下互动,共同将法治政府建设推向前进;其三,在指导原则上,坚持党的领导和人民当家作主的有机统一,始终以人民为主体;其四,在建设目标上,坚持依法行政,力求建成人民满意的法治政府;其五,在建设路径上,各级政府通过制定和积极推进具体详细的建设规划,以及广大人民群众踊跃参与,既强调要大力健全和完善政府行政管理体制机制、优化政府职能,同时还强调要构建科学规范有效的监督体系、监督网络。
[Abstract]:The construction of government by law is one of the core contents of the construction of socialist rule of law with Chinese characteristics. Since the promulgation of the outline for the Comprehensive Promotion of Administration by Law in 2004, there have been more and more studies on the construction of a socialist government ruled by law with Chinese characteristics, but most of the studies have focused on the definition of the meaning of the government ruled by law under the socialist ideology. The study of specific characteristics and construction path, the definition of the connotation of "Chinese characteristics" and the concrete embodiment of "Chinese characteristics" in the construction practice of the government ruled by law still need to be deeply analyzed and discussed. To study the "Chinese characteristics" of the construction of the government ruled by law is to analyze the basic characteristics of the construction of the government under the rule of law from the perspective of "Chinese characteristics", and to explore the concrete embodiment of the "Chinese characteristics" in the field of the construction of the government ruled by law. "Chinese characteristics" is a distinctive feature and unique attribute of China in politics, economy and culture under the socialist system. It is not a simple reference to the construction experience of western developed countries. Instead, it always insists on combining with the characteristics of China's specific times, and through deepening the reform, the superiority of socialism, the theoretical quality of Marxism and the characteristics of the excellent traditional culture of the Chinese nation become more prominent. The "Chinese characteristics" of the construction of the socialist government ruled by law are embodied in the following aspects: first, on the theoretical basis, it is always guided by Marxism, especially the Marxist legal thought, to the theory of the construction of the western government ruled by law. Second, the government promotes, the masses participate and interact with each other to push forward the construction of a government ruled by law. Third, in guiding principles, we should adhere to the organic unity of the leadership of the Party and the people as masters of their own country. We should always take the people as the main body; fourth, we should persist in administering according to law and strive to build a government under the rule of law that the people are satisfied with; fifth, in the path of construction, governments at all levels have worked out and actively promoted specific and detailed construction plans. And the masses participate enthusiastically, which not only emphasizes the need to improve and perfect the system and mechanism of government administration, but also emphasizes the construction of scientific, standardized and effective supervision system and supervision network.
