体育纠纷的法理重述与规范治理——以体育治理法治化为指引

【摘要】：体育纠纷根据纠纷的性质及涉及依据的不同可以分为体育法律纠纷与体育非法律纠纷,体育法律纠纷主要是指在体育活动中发生的涉及法律规则的纠纷;体育非法律纠纷则是指在体育活动中发生的涉及体育自治规则的纠纷。判断体育纠纷是属于法律纠纷还是非法律纠纷的识别标准,主要是看纠纷的性质或者纠纷适用的依据。将体育纠纷区分为体育法律纠纷与非法律纠纷,为不同类型的体育纠纷的规范治理,提供更加具有针对性的方法与路径。对于体育法律纠纷,司法在具有相应条件的前提下可以介入,而非法律纠纷司法则不能介入,其规范治理有赖于认真对待并充分利用体育调解机制与体育仲裁机制的优化组合。同时,注重多种解纷方式的良性互动与有效衔接,形成一个开放的、多元的体育纠纷化解机制,共同推动体育治理的法治化、现代化进程。
[Abstract]:Sports disputes can be divided into sports legal disputes and sports non-legal disputes according to the nature and the basis of the disputes. Sports legal disputes mainly refer to disputes involving legal rules in sports activities. Sports non-legal disputes refer to disputes involving sports autonomy rules in sports activities. To judge whether sports disputes belong to legal disputes or non-legal disputes, it mainly depends on the nature of disputes or the basis of dispute application. Sports disputes are divided into sports legal disputes and non-legal disputes, which provide more targeted methods and paths for the standardized management of different types of sports disputes. For sports legal disputes, the judicature can intervene on the premise of corresponding conditions, but the non-legal dispute judicature can not intervene. Its normative governance depends on seriously treating and making full use of the optimized combination of sports mediation mechanism and sports arbitration mechanism. At the same time, we should pay attention to the benign interaction and effective connection of various ways of resolving disputes, form an open and pluralistic mechanism for resolving sports disputes, and jointly promote the legalization and modernization of sports governance.
