陕西省体育法制建设的现状与发展对策研究

【摘要】：坚持依法治体,加强体育法制建设,不断将体育工作纳入法治轨道,是改革开放以来我国体育持续快速发展的根本保障。自我国《体育法》颁布实施以来,全国各省的体育法制建设均取得了重要进展,也相应的促进了当地体育事业的快速发展。但是,随着我国社会主义民主与法制建设的不断加强和体育事业的发展,对体育法制工作也提出了更高的要求。在新时期下,我国各省市体育事业的发展对陕西省造成一定的冲击,陕西省也更加重视体育法制的建设,陕西省体育法制建设的现状已不适应体育事业发展的需要,必须要结合陕西的实际情况尽快进行完善。体育法制建设是目前陕西体育事业发展中的重要问题之一。也是当前陕西省体育系统一项紧迫而又艰巨的任务。本论文以陕西省体育法制建设为主要研究对象,采用文献资料法、专家访谈法、理论分析等方法,分析了建国60年来我国体育法制建设五个发展阶段的不同特点,重点研究了现阶段陕西省体育法制建设的基本现状和发展中存在的问题,并对陕西省体育法制建设的立法、执法、守法和法律监督情况,以及与其他省市在体育立法上的差距进行了探讨,研究发现陕西省体育法制建设还存在很多问题,得出如下结论：陕西体育立法滞后,质量不高；缺乏体育法制的宣传,形式不够新颖；体育法学研究重视不够,研究队伍薄弱；体育执法主体不明确,组织机构不健全；陕西在学校体育立法、群众体育立法和竞赛立法等方面存在缺陷。最后,为了更好地促进陕西省体育事业的发展,结合社会主义市场经济条件下发展体育事业的要求,提出了陕西体育法制建设发展的对策建议：落实工作重点,提高立法质量；加大体育法制宣传,增强体育法制观念；充分利用地域优势,加强体育法学科研队伍,加强体育法学界的学术交流；规范体育执法行为,建立有效的执法监督；完善学校体育、群众体育等相关的立法体系。因此,以此构建一个合理的、高效的体育法制运行机制,对于逐步完善陕西省体育法制建设的快速发展具有重要的意义。
[Abstract]:It is the fundamental guarantee for the sustained and rapid development of sports in our country since the reform and opening to the outside world to adhere to the rule of law, strengthen the construction of sports legal system and bring sports work into the track of rule by law. Since the promulgation and implementation of the Sports Law in our country, the construction of sports legal system in all provinces of the country has made important progress, which has also promoted the rapid development of local sports undertakings. However, with the continuous strengthening of socialist democracy and legal system construction in China and the development of sports cause, higher requirements are put forward for sports legal work. In the new period, the development of sports in various provinces and cities in China has caused a certain impact on Shaanxi Province, and Shaanxi Province has paid more attention to the construction of sports legal system. The present situation of sports legal system construction in Shaanxi Province has not been adapted to the needs of the development of sports cause. Must be combined with the actual situation in Shaanxi as soon as possible to improve. The construction of sports legal system is one of the important problems in the development of Shaanxi sports. Also is a current Shaanxi Province sports system an urgent and arduous task. This paper takes the construction of sports legal system in Shaanxi Province as the main research object, using the methods of literature, expert interview and theoretical analysis, analyzes the different characteristics of the five stages of the legal construction of sports in China since the founding of the people's Republic of China in the past 60 years. This paper focuses on the basic status quo and problems in the development of sports legal system construction in Shaanxi Province at the present stage, and the legislation, law enforcement, law-abiding and legal supervision of the sports legal system construction in Shaanxi Province. As well as the gap with other provinces and cities in sports legislation, the study found that there are still many problems in the construction of sports legal system in Shaanxi Province, draw the following conclusions: Shaanxi sports legislation lag behind, the quality is not high; lack of sports legal publicity, The form is not new enough; the sports law research is not paid enough attention to, the research team is weak; the main body of sports law enforcement is not clear, the organization is not perfect; Shaanxi has defects in the school sports legislation, the mass sports legislation and the competition legislation and so on. Finally, in order to better promote the development of sports in Shaanxi Province, combined with the requirements of developing sports under the condition of socialist market economy, this paper puts forward the countermeasures and suggestions for the development of sports legal system in Shaanxi: carrying out the key points of work and improving the quality of legislation; Strengthen the publicity of sports legal system, strengthen the concept of sports legal system, make full use of regional advantages, strengthen the scientific research team of sports law, strengthen the academic exchange in sports law field, standardize sports law enforcement behavior, establish effective law enforcement supervision, perfect school sports, Mass sports and other related legislative system. Therefore, it is of great significance to construct a reasonable and efficient running mechanism of sports legal system for the gradual improvement of the rapid development of sports legal system in Shaanxi Province.
