论邓小平法治思想与中国特色社会主义法治国家建设

【摘要】： 邓小平同志立足中国现实国情,放眼国内外,在继承发扬中国传统法律文化和借鉴西方法治文明的基础上,形成了一套完整的有中国特色的社会主义法治理论,极大地丰富了马克思主义法学的理论宝库。邓小平的法治思想是对马列主义、毛泽东思想的继承和发展,是中国摈弃人治走向法治,实现当代中国政治模式现代化转型的理论指南。邓小平同志将马克思主义与中国的具体实践相结合,明确提出建设中国特色社会主义法治国家的基本要求。他强调崇尚法治,反对人治,主张实现由人治的治国方式转向法治的治国方式;要求树立法律的极大权威,加快建立完备的中国特色社会主义法律体系;强调继续抓好经济建设和法治建设,促进经济和法治的平衡发展;强调加大法律的宣传和教育力度,更快地增强全民的法律意识;强调完善司法及监督体制,推进司法制度改革,为法律创造良好的运行机制;强调加快完善有关监督及防腐的法律体系,建立健全依法行政的制约机制。建设中国特色社会主义法治国家,首先应有中国特色,同时要坚持社会主义法治,而不是西方的法治。要有中国特色,就必须将邓小平的法治思想与中国当前法治建设的方方面面紧密结合,解决当前中国法治建设的现实问题。要坚持社会主义法治,就必须明确中国特色社会主义法治与西方法治的区别。科学的认识邓小平法治思想,深刻领会和准确把握邓小平法治思想的精神实质和时代价值,对于我们建设中国特色社会主义法治国家具有重要的理论价值和现实意义。
[Abstract]:Comrade Deng Xiaoping, based on China's actual national conditions, looking at the domestic and foreign countries, on the basis of inheriting and carrying forward Chinese traditional legal culture and drawing lessons from the western civilization of rule of law, has formed a complete theory of socialist rule of law with Chinese characteristics. It has greatly enriched the theoretical treasure house of Marxist law. Deng Xiaoping's thought of ruling by law is the inheritance and development of Marxism-Leninism and Mao Zedong thought, which is the theoretical guide for China to abandon the rule of man and move to the rule of law and realize the modernization transformation of contemporary Chinese political model. Comrade Deng Xiaoping combines Marxism with China's concrete practice and puts forward the basic requirements of building a socialist country ruled by law with Chinese characteristics. He emphasized advocating the rule of law, opposing the rule of law, advocating the change from the rule of law to the rule of law, demanding the establishment of a great authority of the law, speeding up the establishment of a complete socialist legal system with Chinese characteristics; We should continue to do a good job in economic construction and rule by law, promote the balanced development of economy and the rule of law, strengthen the publicity and education of the law, and strengthen the legal consciousness of the whole people more quickly. Emphasis is placed on perfecting the judicial and supervisory system, pushing forward the reform of the judicial system, creating a good operating mechanism for the law, speeding up the improvement of the legal system of supervision and anticorrosion, and establishing and perfecting the restriction mechanism of administration by law. To build a socialist country ruled by law with Chinese characteristics, we should first of all have Chinese characteristics, and at the same time adhere to the socialist rule of law, not the rule of law in the West. In order to have Chinese characteristics, Deng Xiaoping's thought of rule of law must be closely combined with all aspects of China's current construction of rule of law to solve the practical problems of current construction of China's rule of law. To adhere to the socialist rule of law, we must make clear the difference between the socialist rule of law with Chinese characteristics and the western rule of law. It is of great theoretical value and practical significance for us to build a socialist country ruled by law with Chinese characteristics by scientifically understanding Deng Xiaoping's thought of ruling by law, deeply understanding and accurately grasping the spiritual essence and the value of the times of Deng Xiaoping's thought of rule of law.
