论建设我国集约型经济增长方式的行政法治研究

【摘要】：胡锦涛总书记明确指出,当前我国经济增长方式的转变和经济结构的调整,已经到了刻不容缓的地步。我们是社会主义市场经济国家,国家对经济有着强有力的宏观调控,政府的行为与经济增长有着密切的联系。本文旨在通过规范政府的行政行为,以实现经济增长方式的彻底转型。要建设集约型经济增长方式,首先,就政府官员的行为而言,我们要改变过去单纯追求经济总量增长的绩效评估指标体系,建设追求经济效率、重视降低能耗、重视科技水平综合提高的绩效评估体系,转变政府的发展思路；其次,就政府职能转就而言,应当积极建立服务型政府,落实有限政府、责任政府,为集约型经济提供一个良好的法治环境；再次,政府要完善行政指导行为,充分利用行政指导行为来对经济进行调控,规范行政指导的方式,落实相关的产业计划和产业政策,完善行政指导行为的制定与实施；最后,在行政法治运行领域,我们应积极做好促进集约型经济增长的制度因应,在立法上,加快行政基本法与教育和科技的立法,在执法上,要严格执行国家对环境和资源领域的法律法规,在司法上,要做到公正司法,给市场一个公平、公正的法治空间。只有这样,我们的行政法治才能更好的服务于经济,才能建立起我国的集约型经济增长方式。通过审视行政法运行的全过程来研究它对向集约型经济增长方式转变的途径和重要作用,这样不仅加深了法与经济这一法学永恒命题的理解,同时也能为我们行政决策者与我们的司法运行提供一些参考。
[Abstract]:General Secretary Hu Jintao clearly pointed out that the transformation of China's economic growth mode and the adjustment of its economic structure have reached the point of urgency. We are a socialist market economy country, the country has strong macro-control to the economy, the government's behavior has close relation with the economic growth. The purpose of this paper is to realize the complete transformation of economic growth mode by standardizing the administrative behavior of the government. To build an intensive mode of economic growth, first of all, as far as the behavior of government officials is concerned, we need to change the performance evaluation index system that used to simply pursue total economic growth, build economic efficiency, and attach importance to reducing energy consumption. Pay attention to the performance evaluation system of the comprehensive improvement of science and technology level, change the government's development thought; Secondly, as far as government functions are concerned, we should actively establish a service-oriented government, implement a limited government and take responsibility of the government so as to provide a good legal environment for the intensive economy. Third, the government should perfect the administrative guidance behavior, make full use of the administrative guidance behavior to regulate the economy, standardize the way of administrative guidance, implement the relevant industrial plan and industrial policy, perfect the formulation and implementation of the administrative guidance behavior; Finally, in the field of the operation of the administrative rule of law, we should actively do a good job in responding to the system of promoting intensive economic growth. In terms of legislation, we should speed up the basic administrative law and the legislation on education and science and technology, and enforce the law. It is necessary to strictly enforce the laws and regulations in the field of environment and resources. In the administration of justice, we should do justice and give the market a fair and just space for the rule of law. Only in this way, our administrative rule of law can better serve the economy and establish our country's intensive economic growth mode. By examining the whole process of the operation of administrative law, this paper studies the way and important role of administrative law in transforming to intensive economic growth mode, which not only deepens the understanding of law and economy, which is the eternal proposition of law. At the same time, it can also provide some reference for our administrative decision makers and our judicial operation.
