论我国技术侦察的法治化

【摘要】:随着犯罪的智能化、组织化、隐蔽化程度的不断提高,传统的常规侦查措施面临着前所未有的危机与挑战。技术侦察措施作为应对新形势下犯罪变化的需要,已经在世界范围内广泛运用,在打击与控制犯罪中发挥了常规侦查手段所不可替代的作用。但是如果使用不当,就会极易侵犯公民的基本权利。因此,如何通过立法手段对技术侦察进行规制,平衡技术侦察手段在打击犯罪与保障人权价值上的冲突,实现技术侦察的法治化,成为当前立法与司法实践的重要课题。本文从技术侦察的一般理论入手,在考察了世界各主要法治国家和地区的技术侦察立法、司法实践及其相关学说的基础上,结合我国技术侦察之实际情况,提出了构建我国技术侦察法治化的初步设想。全文共分四章,共约五万余字。 第一章对技术侦察进行概括阐述。首先考察论证了技术侦察的概念和特征;接着阐述了几种主要的技术侦察措施;最后分析了技术侦察与相关概念的区别与联系。 第二章是对域外技术侦察的比较法考察。本章首先对大陆法系国家、英美法系国家以及我国港、澳、台地区的技术侦察的立法、司法实践及其相关学说进行了考证,并在此基础上对其进行了分析,然后指出对我国技术侦察法治化的借鉴意义。 第三章是我国技术侦察的立法及其实践状况。首先介绍了我国技术侦察立法上的相关规定,并指出我国现行法律规定的缺陷与不足;其次分析了我国技术侦察在司法实践中存在的问题;最后从观念障碍、缺乏有效的权力制约机制、现存诉讼结构不合理以及相关刑事诉讼制度不健全四个方面分析我国技术侦察法律规制不足的原因。 第四章对我国技术侦察法治化的基本构想进行详细论述,也是本文最重要的一章。本章首先分析了我国技术侦察法治化的必要性与可行性;其次提出了我国技术侦察法治化首先应确立的基本原则;在确立基本原则的基础上,具体探讨了我国技术侦察法治化的立法设计,包括技术侦察立法模式的选择、技术侦察权的配置、技术侦察的适用范围及条件、技术侦察的实施期限、技术侦察的适用对象、技术侦察的实施程序、技术侦察所获信息资料的使用与处理以及非法技术侦察行为的制裁机制与救济途径等。
[Abstract]:With the intelligence, organization and concealment of crime, the traditional investigation measures are facing unprecedented crisis and challenge. As the need of responding to the change of crime under the new situation, technical reconnaissance measures have been widely used in the world, and have played an irreplaceable role in the fight and control of crime. However, if used improperly, it will be extremely vulnerable to infringe upon the fundamental rights of citizens. Therefore, how to regulate the technical reconnaissance by means of legislation, balance the conflict between the value of the technical reconnaissance and the protection of human rights, and realize the legalization of the technical reconnaissance has become an important topic in the current legislation and judicial practice. Starting with the general theory of technical reconnaissance, this paper investigates the legislation, judicial practice and related theories of technical reconnaissance in the major countries and regions ruled by law in the world, and combines the actual situation of technical reconnaissance in China. This paper puts forward the tentative idea of constructing the rule of law of technical reconnaissance in our country. The full text is divided into four chapters, a total of more than 50,000 words. The first chapter gives a general description of technical reconnaissance. Firstly, the concept and characteristics of technical reconnaissance are investigated and demonstrated, and then several main technical reconnaissance measures are expounded. Finally, the differences and relations between technical reconnaissance and related concepts are analyzed. The second chapter is a comparative investigation of extraterritorial technical reconnaissance. Firstly, this chapter studies the legislation, judicial practice and related theories of technical reconnaissance in the countries of civil law system, common law system and Hong Kong, Macao and Taiwan of our country, and then analyzes it on the basis of the analysis of the legislation, judicial practice and related theories of technical reconnaissance in Hong Kong, Macao and Taiwan. Then it points out the reference significance to the rule of law of technical reconnaissance in our country. The third chapter is about the legislation and practice of technical reconnaissance in our country. This paper first introduces the relevant regulations in the legislation of technical reconnaissance in our country, and points out the defects and deficiencies of the current legal provisions in our country, then analyzes the problems existing in the judicial practice of the technical reconnaissance in our country. Finally, this paper analyzes the reasons for the lack of legal regulation of technical reconnaissance in China from four aspects: the obstacle of concept, the lack of effective power restriction mechanism, the unreasonable structure of existing litigation and the imperfection of related criminal procedure system. The fourth chapter discusses in detail the basic conception of the rule of law of technical reconnaissance in our country, which is also the most important chapter of this paper. This chapter first analyzes the necessity and feasibility of the rule of law of technical reconnaissance in our country, and then puts forward the basic principles that should be established in the first place of the rule of law of technical reconnaissance of our country. On the basis of establishing the basic principles, this paper discusses the legislative design of the legalization of technical reconnaissance in China, including the choice of legislative mode of technical reconnaissance, the configuration of technical reconnaissance power, and the applicable scope and conditions of technical reconnaissance. The implementation time limit of technical reconnaissance, the applicable object of technical reconnaissance, the implementation procedure of technical reconnaissance, the use and processing of information obtained by technical reconnaissance, and the sanction mechanism and relief way of illegal technical reconnaissance behavior, etc.
