流浪乞讨人员社会救助法律制度的完善

【摘要】：流浪乞讨人员作为一种特殊的社会群体长期普遍存在,古今中外世界各国政府都一直在寻找解决这一难题的良药。但由于历史、社会、经济、文化以及其自身等诸多原因,在当前,这个问题仍没有得到很好的解决。到了现代社会,人们发现建立一套完善的社会保障和社会救助制度是解决流浪乞讨现象的关键。2003年6月我国颁布《城市生活无着的流浪乞讨人员救助管理办法》(以下简称《救助管理办法》),新的救助管理制度的施行体现了我国社会保障与社会救助制度的进步,在各方面也取得了很好的成效,但新的《救助管理办法》由于立法仓促等原因,还存在很多的困境和问题,所以要想解决好流浪乞讨问题必然要以完善流浪乞讨人员救助制度为突破口。本文第一部分主要对城市流浪乞讨人员的社会救助制度进行了理论介绍,从流浪乞讨人员的概念与范围入手,进而阐述了流浪乞讨人员社会救助制度的概念、特征及必要性。为下文做好理论铺垫。第二部分回顾了我国流浪乞讨人员社会救助制度的历史发展。这一部分把我国对流浪乞讨人员的救助态度分为三个阶段,即:古代封建社会对流浪乞讨的善政之举;近代对流浪乞讨管理的法制化尝试;新中国成立后我国流浪乞讨人员救助制度的实践。第三部分重点分析了我国流浪乞讨人员救助制度存在的问题,在肯定取得诸多成效的同时,指出我国社会救助制度在发展中存在的问题。第四部分为文章的重点,首先介绍了西方社会对流浪乞讨人员的态度和规制,其次分析了美国、英国、日本等发达国家在流浪乞讨人员救助方面采取的措施,总结出经验教训,最后结合我国的国情,提出适合我国城市流浪乞讨人员社会救助制度的对策建议。
[Abstract]:As a special social group, vagrants and beggars have long existed, and governments all over the world have been looking for a good remedy to solve this problem. However, due to many reasons, such as history, society, economy, culture and themselves, At present, this problem is still not well solved. In modern society, People found that establishing a set of perfect social security and social assistance system is the key to solve the phenomenon of vagrant begging. In June 2003, our country promulgated the "Administrative measures for the Relief of homeless beggars who have nothing to do with Urban Life" (hereinafter referred to as "Relief"). The implementation of the new relief management system reflects the progress of China's social security and social assistance system. Good results have also been achieved in various aspects, but there are still a lot of difficulties and problems due to the haste of legislation and other reasons. Therefore, in order to solve the problem of vagrant begging, it is necessary to improve the relief system for vagrants and beggars as a breakthrough. The first part of this paper mainly introduces the social assistance system of urban vagrant beggars. Starting with the concept and scope of vagrant beggars, this paper expounds the concept of social assistance system for vagrants and beggars. The second part reviews the historical development of the social assistance system for vagrants and beggars in China. This part divides our country's attitude towards vagrants and beggars into three stages. That is: the good governance of the ancient feudal society to vagrancy and begging, the attempt of legalizing the management of vagrancy and begging in modern times; The third part focuses on the analysis of the problems existing in the system of vagrant and beggar assistance in China, and at the same time, it is sure to achieve a lot of results. This paper points out the problems existing in the development of the social assistance system in China. Part 4th is the focus of the article. Firstly, it introduces the attitudes and regulations of the western society towards vagrants and beggars, and then analyzes the United States, Britain, the United States, the United Kingdom, the United States and the United Kingdom. The measures taken by Japan and other developed countries in the field of vagrant and beggar assistance are summed up and the experiences and lessons are summed up. Finally, combined with the national conditions of our country, the author puts forward some countermeasures and suggestions suitable for the social assistance system of the urban vagrant beggars in our country.
