海洋强国战略背景下我国船员劳动和社会保障制度构建刍议

【摘要】:海洋强国战略的提出要求我国重视船员的劳动和社会保障问题。船员职业的特殊性主要表现为海事活动的风险性、生活条件的艰苦性以及船员劳动的涉外性。船员就业模式的发展变化、我国国内船员立法的完善以及履行《2006年海事劳工公约》,要求我国构建专门的船员劳动和社会保障制度。航运发达国家均建立了相对完善的船员劳动和社会保障制度,我国的制度构建应当通过《海商法》第三章"船员"的修改实现。船员劳动制度的构建应以船员劳动合同为核心,船员社会保障制度的构建则应以船员社会保险为核心。
[Abstract]:The strategy of a powerful marine country requires China to pay attention to the labor and social security of crew members. The particularity of crew occupation is mainly manifested in the risk of maritime activities. The hardship of living conditions and the foreign-related nature of crew labor. The development and change of crew employment mode, The perfection of China's domestic crew legislation and the implementation of the Maritime Labour Convention of 2006 require China to set up a special seamen labor and social security system. The system construction of our country should be realized through the revision of the third chapter of the Maritime Law "crew". The construction of the crew labor system should take the crew labor contract as the core, and the crew social security system should take the crew social insurance as the core.
