贵州省劳务派遣监管法律机制实证研究

【摘要】:劳务派遣作为新的就业模式和用工形式对我国劳动领域产生了深远的影响,对我国经济的发展和就业多元化具有十分重要的作用。但是,由于劳动者和用人单位之间供求关系失衡及行政机关监管工作不到位,劳务派遣工的合法权益得不到立法者预期的全面有效保护。那么劳务派遣监管工作成效到底如何,还存在哪些问题需要解决,值得进一步选定区域进行调研和分析。2013年7月以及2014年4月,我国相继出台了《劳务派遣行政许可实施办法》和《劳务派遣暂行规定》,对于经营劳务派遣业务的单位的资质以及违反规定所要承担的法律责任做了明确的规定,同时也为行政机关如何监管劳务派遣活动提供了较为全面的制度规范,行政机关在运用这些制度对劳务派遣活动进行监管时,会面临哪些问题,存有哪些困境值得进一步探讨。本课题通过对贵州省劳务派遣用工现状以及贵州省人力资源和社会保障厅在监管劳务派遣活动所面临的问题的调研,找出行政机关在劳务派遣监管工作中所存在的问题,提出完善贵州省劳务派遣监管制度的建议,促进劳务派遣行业在贵州省不断规范有序的发展,维护劳务派遣单位以及劳务派遣劳动者的合法权益。全文分为四个部分。首先,是阐述本课题的选题原由以及意义,主要从理论意义、实践意义两个方面来阐述劳务派遣监管制度现状对于贵州省劳务派遣监管措施和发展方向所产生的重要意义。其次,是对调研的基本情况的介绍,主要包括选择贵州省人社厅作为调研点的理由、调研经过、调研方法。再次,是对调研数据的整理。最后,在调研数据整理的基础上,分析贵州省劳务派遣监管制度中存在的问题,并提出解决的对策。
[Abstract]:As a new employment mode and employment form, labor dispatch has a profound influence on the labor field of our country, and plays a very important role in the economic development and employment diversification of our country. However, due to the imbalance between supply and demand between workers and employers and the lack of supervision by administrative organs, the legitimate rights and interests of labor dispatch workers are not fully and effectively protected as expected by legislators. Well, how effective is the supervision of labor dispatch, and what problems remain to be solved, which are worthy of further research and analysis in selected regions. In July 2013 and April 2014, China has successively promulgated the measures for the implementation of Administrative Licensing of Labor dispatching and the interim provisions on Labor Dispatch, which has made clear provisions on the qualifications of the units operating the dispatch of labor services and the legal liabilities to be assumed in violation of the regulations. At the same time, it also provides a more comprehensive system for administrative agencies how to supervise labor dispatch activities. When administrative agencies use these systems to supervise labor dispatch activities, what problems will they face and what difficulties are worth further discussing. Through investigating the current situation of labor dispatch in Guizhou province and the problems faced by Guizhou Human Resources and Social Security Department in supervising labor dispatch activities, the paper finds out the problems existing in the supervision of labor dispatch by administrative organs. Some suggestions are put forward to improve the supervision system of labor dispatch in Guizhou province, to promote the development of labor dispatch industry in Guizhou Province, and to safeguard the legitimate rights and interests of labor dispatch units and labor dispatch workers. The full text is divided into four parts. First of all, it expounds the reason and significance of this topic, mainly from the theoretical significance, practical significance of the labor dispatch supervision system for Guizhou Province labor dispatch supervision measures and development direction of the importance of the significance. Secondly, it introduces the basic situation of the investigation, including the reasons for choosing Guizhou Provincial people's Social Service as the research point, the research process and the research methods. Again, is the collation of the survey data. Finally, on the basis of the investigation data, this paper analyzes the problems existing in the supervision system of labor dispatch in Guizhou province, and puts forward some countermeasures.
