海外中国企业员工安全风险防范的政府职能研究

【摘要】:随着中国实施“走出去”战略以及近年来推行的“一带一路”建设,中国企业走出去的步伐越来越快,也带动了越来越多的中国公民走出国门就业,但与此同时,各种安全风险严重威胁着海外中国企业员工的财产及生命安全。本文运用突发事件理论及应急管理理论等相关理论,采用文献研究法和案例研究法,结合政府的规制职能、预警职能和保障职能,首先分析海外中国企业的分布行业主要为服务业、制造业和采矿业等,分布国家和地区广泛但不均衡,安全风险发生区域可划分为高危、危险和安全三个地带;其次分析海外中国企业员工面临着自然灾害、事故灾难、公共卫生安全以及公共安全事件等四种安全风险及其危害,并结合案例分析我国政府通过制定保护海外中国企业员工安全风险的法律和预案以及风险防范和协助机制来行使其规制、预警及保障职能;第三分析我国政府在海外中国企业员工安全风险防范中存在着安保能力及服务体系不足、信息收集及研判能力不足、保护途径狭隘、事后恢复机制不到位、行前教育存在误区等问题,究其原因主要有法律制度不完善;安保、保护及应对机制均不完善;政府的保障作用不足,表现为驻外机构及经费投入、对海外员工的教育、对外政策、政府监管均存在不足等;当地华侨华人及中国企业发挥作用不足。文章最后在分析问题及原因并借鉴美国、日本及俄罗斯的保护海外员工安全的经验的基础上,从完善涉外安全风险防范法律、健全政府在海外安全风险防范中的预警机制、加强政府在海外安全风险防范中的保障作用以及重视当地华侨华人和中国企业的作用四个方面来对海外中国企业员工安全风险的政府防范职能的完善提出建议和对策。
[Abstract]:With the implementation of the "going out" strategy in China and the construction of "Belt and Road" implemented in recent years, the pace of Chinese enterprises going out is getting faster and faster, which has also led more and more Chinese citizens to go abroad for employment, but at the same time, All kinds of security risks seriously threaten the property and life safety of overseas Chinese enterprise employees. This paper uses the theory of emergency and emergency management theory, the literature research method and the case study method, combined with the regulation function of the government. The early warning function and the safeguard function, first of all, the distribution industries of overseas Chinese enterprises are mainly service industry, manufacturing industry and mining industry. The distribution of countries and regions is extensive but uneven, and the region where security risks occur can be classified as high risk. There are three zones of danger and safety. Secondly, the paper analyzes the four kinds of safety risks and hazards faced by the employees of overseas Chinese enterprises such as natural disaster, accident disaster, public health safety and public safety incident. Combined with the case study, our government exercises its functions of regulation, early warning and protection by making laws and plans to protect the security risks of the employees of overseas Chinese enterprises, as well as risk prevention and assistance mechanism. The third analysis is that the Chinese government has insufficient security capability and service system, insufficient information collection and research ability, narrow protection approach, and inadequate post-incident recovery mechanism in preventing the security risks of overseas Chinese enterprises' employees. Problems such as misunderstandings in pre-industry education are mainly due to imperfect legal system; imperfect security, protection and coping mechanisms; inadequate protection by the government. These problems are manifested in the presence of foreign organizations and investment in funds, and the education of overseas employees. Foreign policy and government supervision are inadequate, local overseas Chinese and Chinese enterprises play an insufficient role. Finally, the article analyzes the problems and causes and draws lessons from the experience of the United States, Japan and Russia in protecting the safety of overseas employees. From perfecting the foreign security risk prevention law and perfecting the early warning mechanism of the government in the overseas security risk prevention, Strengthening the role of the government in the protection of overseas security risks and attaching importance to the role of local overseas Chinese and Chinese enterprises are four aspects to improve the government's preventive function of overseas Chinese employees' security risks.
