当代大学生法治观念培育研究

【摘要】:法治,是人类社会的文明指针、是各民族共同的价值追求,是当代中国笃行的社会理想。法律的权威源自人民的内心拥护和真诚信仰,在当代中国的法治实践中,公民的法治观念起着先行作用,是法治中国理想能否实现的关键。当代大学生法治观念培育不仅是我国公民法治观念培育体系的重要组成部分,也是我国现代高等教育的重要内容之一。本文以马克思主义理论为指导,以思想政治教育视角切入当代大学生社会主义法治观念培育问题,运用文献分析、定性分析、系统分析、社会调查等方法,既立足于现实,又梳理历史;既注重理论研究,又落脚于教育实践;既强调教育要素的创新,又重视长效机制的建立。整个论文的核心主旨在于破解“如何正确理解当代大学生法治观念培育”这一问题,并构建当代大学生法治观念培育的长效机制。本文共分为绪论、正文和结语三大部分,其中正文部分共六章,遵循“认清时代需要——梳理历史脉络——明晰现实问题——探究机制策略”的基本逻辑来建构。第一章对当代大学生法治观念的时代背景进行了深度解读。法治是当代中国改革和发展的最强音,在“四个全面”战略布局中担当着有力支撑,是“两个百年”奋斗目标和中华民族伟大复兴梦的重要保障。当代大学生法治观念培育作为我国全面推进依法治国中的基础性环节,应符合当代中国法治新制度、新舆论、新实践的要求,符合高等教育“立德树人”的新期待。从现实回到历史,本文第二章研究了改革开放以来我国大学生法治观念培育的历史经验,以七次全民普法规划和高校对大学生法治观念培育的回应为脉络,将改革开放以来我国大学生法治观念培育的进程分为了四个阶段。并总结出了对当代大学生法治观念培育有启示意义的具体经验:发挥法律基础课程在大学生法治观念培育中的核心作用;注重校园文化建设对大学生法治观念培育的积极影响;以依法治校推动大学生法治观念的树立;始终坚持法治观念培育与德育的紧密结合;及重视大学生法治观念培育的规范化、制度化建设。以问题为导向,本文第三章分析了当代大学生法治观念的现状、当代大学生法治观念培育的现状及当前大学生法治观念培育面临的多维困境。通过对大学生法治认知、法治评价、法治情感和法治行为的社会调查,揭示出当代大学生法治观念现状还不乐观。同时,详细考察了当前高校在大学生法治观念培育方面的具体做法,阐述了其在法治观念培育课程体系、《法律基础》课教学、法治教育实践活动及校园法治文化环境方面存在的问题。并进一步从中国传统法文化与社会主义法治观念的冲突、西方自然法传统与宪政思想的价值迷惑、现实司法运作的弱公信力、高校人才培养中的教育偏离等维度,探究总结了当代大学生法治观念培育存在的困境。遵循“问题——原因——对策”的逻辑,本文后三章聚焦于如何对当代大学生进行法治观念培育。依据现实问题和困境、国家与社会的期待、大学生个人成长的规律和需求,本文第四章构建了当代大学生法治观念培育相互联系、层层递进的目标体系,即使当代大学生形成中国特色社会主义法治之理性认知、产生社会主义法治价值之深度认同、萌生敬畏法治之情感体验、进而树立建设社会主义法治国家之理想信念,并形成依法办事之思维习惯。以中国特色社会主义法治为研究对象,本文所指的法治观念在内容上包含党的领导、人民当家作主与依法治国相统一观念、依法治国与以德治国相结合观念、法治的核心价值观念、权利和义务观念、权力的合理定位观念及法律主治观念。本文第五章着重于探讨当代大学生法治观念培育的新方法及综合路径的运用,提出了运用于法律选修课的咨询式教学法、运用于学生行政管理的团体教育法、及运用于学生行为规范的遵纪守法信用档案等具备时代特征和现实操作性的新方法。在教育路径上,提出要优化课堂教育,构建大学生法治观念培育课程体系;拓展实践活动,为大学生法治观念深化提供着力点;营造文化环境,使大学生产生法治沉浸体验:开发网络资源,丰富大学生自主学习渠道;加强依法治校,发挥管理对大学生的教育功效,使各教育路径发挥出综合功效。最后,本文第六章致力于发挥当代大学生法治观念培育各要素的系统功效,提出构建当代大学生法治观念培育的长效机制。通过建立课堂法治观念教育与日常法治管理并行机制、法治观念理论教育与法治实践引导互动机制、学校法治观念培育与社会法治宣传教育协同机制、学校教育主体与政府、家庭、媒体等力量联动机制,实现当代大学生法治观念培育的长效化、系统化、规范化。
[Abstract]:The rule of law is the pointer of the civilization of human society, the pursuit of the common values of all ethnic groups and the social ideal of contemporary China. The authority of the law derives from the inner support and sincere belief of the people. In the practice of the rule of law in contemporary China, the concept of the rule of law of the citizens plays a leading role and is the key to the realization of the ideal of the rule of law in China. The cultivation of the concept of rule of law is not only an important part of the cultivation system of the concept of the rule of law of our citizens, but also one of the important contents of modern higher education in China. This paper, guided by Marx theory, takes the perspective of Ideological and political education as an entry into the cultivation of socialist concept of socialist rule of law for contemporary college students, and uses literature analysis and qualitative analysis. The methods of unified analysis and social investigation are not only based on the reality, but also combing the history. They not only pay attention to the theoretical research, but also fall on the practice of education. They not only emphasize the innovation of the educational elements, but also attach importance to the establishment of long-term mechanism. The core of the whole thesis is to solve the problem of "how to correctly understand the cultivation of the rule of law for the students of the generation". This article is divided into three parts: introduction, text and conclusion, including six chapters in the text, which follows the basic logic of "clear the needs of the times - clear the historical context - clear realistic problems - inquiry mechanism strategy". The first chapter is the era of the concept of the rule of law for Contemporary College Students The rule of law is the strongest voice in the reform and development of contemporary China. It is a strong support in the "four comprehensive" strategic layout. It is an important guarantee for the goal of "two hundred years" and the great revival dream of the Chinese nation. The cultivation of the concept of rule of law for contemporary college students is the basis for China to carry out the rule of law in an all-round way. The link should be in line with the new system of the rule of law in China, the new public opinion and the requirements of the new practice. It is in line with the new expectation of the "Lide tree man" of higher education. From reality back to history, the second chapter of this article studies the historical experience of the cultivation of the concept of rule of law for college students in China since the reform and opening to the outside world, with the plan of seven universal universal law and the cultivation of university students' concept of rule of law. The process of cultivating the concept of rule of law of college students in China has been divided into four stages since the reform and opening up. It also summarizes the specific experience that has enlightenment to the cultivation of the concept of the rule of law for contemporary college students: to play the core role of the basic course of law in the cultivation of the concept of the rule of law of college students; to pay attention to the construction of campus culture for College Students The positive influence of the cultivation of the rule of law, the establishment of the concept of rule of law for college students by the rule of law, the close combination of the cultivation of the concept of rule of law and the moral education, and the standardization of the cultivation of the concept of the rule of law for College students, the institutionalized construction. The third chapter of this article analyzes the present situation of the concept of the rule of law of the contemporary college students and the contemporary university. The present situation of the cultivation of the concept of the rule of law and the multidimensional predicament facing the cultivation of the rule of law of college students. Through the social investigation of the cognition of the rule of law of the university students, the evaluation of the rule of law, the emotion of the rule of law and the rule of law, the present situation of the rule of law of the university students is not optimistic. At the same time, a detailed examination is made on the cultivation of the concept of the rule of law in college students. It also expounds the existing problems in the cultivation of the curriculum system of the concept of rule of law, the teaching of the legal basis, the practice of the rule of law and the cultural environment of the rule of law in the campus, and further from the conflict between the traditional Chinese law culture and the concept of the socialist rule of law, the value of the western natural law tradition and the constitutional thought, and the realistic judicature. The weak public credibility of the operation and the education deviation in the training of talents in Colleges and universities have explored and summed up the plight of the cultivation of the concept of rule of law for contemporary college students. The following three chapters focus on how to cultivate the concept of the rule of law for contemporary college students. In the fourth chapter, the author constructs the relationship between the rule of law of the contemporary college students and the target system of progressive development, even if the contemporary college students form the rational cognition of the socialist rule of law in the socialism with Chinese characteristics, the deep recognition of the value of the socialist law and the emotion of the rule of law in the fear of the socialist law. Experience, and then establish the ideal and belief of building a socialist country ruled by law, and form the habit of thinking in accordance with the law. Taking the rule of law of socialism with Chinese characteristics as the research object, the concept of rule of law in this article contains the leadership of the party, the concept of the unity of the people and the rule of law, the combination of the rule of law and the rule of virtue. The core values of the rule of law, the concept of rights and obligations, the concept of rational positioning of power and the concept of legal governance. The fifth chapter focuses on the exploration of the new methods and the application of the comprehensive path for the cultivation of the concept of rule of law for contemporary college students, and puts forward a consultative teaching method applied to the elective course of law and the group teaching in the administrative management of the students. In the education path, it is proposed to optimize the classroom education, to build up the curriculum system for the cultivation of the concept of the rule of law for college students, to expand the practical activities, to provide the focus for the deepening of the concept of the rule of law for college students, and to create a cultural environment, so as to create a cultural environment, so as to create a cultural environment. Students experience the immersion experience of the rule of law: developing network resources, enriching college students' independent learning channels, strengthening the management of school according to law, giving play to the educational efficacy of management to college students and making all the educational paths play a comprehensive effect. Finally, the sixth chapter of this article is devoted to the systematic efficacy of the modern college students' concept of rule of law to cultivate the various elements, and to put forward the construction of contemporary large scale.
