中国法律翻译发展的回顾与前瞻

【摘要】：中国法律翻译肇始于清末,鸦片战争后的救亡图存运动和传教士等翻译主体的出现,使中国法律翻译的兴起成为可能。传教士及我国本土译者主要译介了国际法、民商法等外国法律和法学著作,其中,国际法的翻译占主导。传教士的翻译策略主要体现在以归化为主,多种翻译方法并用,而我国本土译者梁启超则提出了“转译”的翻译策略。清末民初法律翻译的方法主要为音译法、直译法、意译法等,翻译机构多由官方组织,翻译的书籍大部分来自日本,其次是英美法等国。这一时期的法律翻译对之后的翻译标准、翻译技巧等翻译理论与实践的发展,起到了至关重要的作用,推动了我国译学的发展。中国法律翻译在建国后不断发展,新中国成立初期主要译介了苏联法律和法学著作,苏联翻译理论传入中国。改革开放后,法律翻译走向繁盛,法律翻译作品更加规模化、体系化,国别和语种也更加多元化。此时,西方翻译理论引入中国,法律翻译的标准被提出,法律翻译的译者在翻译策略上越来越重视对文化内涵的适应性选择转换,翻译方法也更加多样,出现了如注释法、模糊对等法等法律翻译方法。本文在对我国法律翻译发展历程回顾的基础之上,从法律翻译理论的完善和实践的发展趋势两方面对法律翻译的走向展开了探讨,对于法律翻译理论体系的构建、法律翻译方法论的研究、法律翻译标准的统一以及法律文本英译及汉译的实践发展提出了个人见解,为我国法律翻译的可持续性发展提供理论依据和支持。
[Abstract]:Chinese legal translation began in the late Qing Dynasty, after the Opium War, the movement to save the nation and the emergence of missionaries and other translation subjects. It makes possible the rise of Chinese legal translation. Missionaries and native translators have mainly translated and introduced foreign laws and legal works, such as international law, civil and commercial law and so on. The translation strategy of missionaries is mainly embodied in domestication and the use of various translation methods. Chinese native translator Liang Qichao put forward the translation strategy of "transliteration". In the late Qing Dynasty and early Republic of China, the main methods of legal translation were transliteration, literal translation, free translation and so on, and the translation institutions were mostly organized by the government. Most of the translated books come from Japan, followed by Anglo-American law and other countries. The legal translation of this period played a vital role in the development of translation theory and practice, such as translation standards and translation techniques. Chinese legal translation developed continuously after the founding of the people's Republic of China. In the early stage of the founding of New China, the Soviet Union's legal and legal works were mainly translated and introduced into China. After the reform and opening up to the outside world, the Soviet translation theory was introduced into China. With the development of legal translation, the legal translation works become more large-scale and systematic, and the countries and languages are more diversified. At this time, the western translation theory is introduced into China, and the standard of legal translation is put forward. The translators of legal translation pay more and more attention to the adaptation of cultural connotations in translation strategies, and the translation methods are more diverse, such as annotation. Based on the review of the development of legal translation in China, this paper probes into the trend of legal translation from two aspects: the perfection of legal translation theory and the development trend of legal translation practice. The author puts forward his own opinions on the construction of legal translation theory system, the study of legal translation methodology, the unification of legal translation standards, and the practical development of legal translation from English to Chinese. It provides theoretical basis and support for the sustainable development of legal translation in China.
