商标标识的商业性合理使用

【摘要】:本文从反思商标合理使用制度目前存在的问题入手,探讨商标领域合理使用制度的理论基础和实践背景,论述商标合理使用制度的合理性和必然性。在理清相关基本概念,正确认识合理使用的基础上,结合合理使用制度的设计初衷重新建构合理使用制度,重新界定其内涵、地位和构成要件,理顺合理使用和侵权认定的关系。通过探讨国外先进立法规定和相关典型案例,在对我国立法现状分析的基础上针对不同的使用类型提出具体的立法建议,以期我国合理使用制度能更好地应用于实践,更好地平衡商标权人、其他经营者和消费者三者的利益,定纷止争,,构建公平有序的市场秩序。本文主体内容主要分为四大部分: 第一部分反思我国目前商标合理使用制度存在的问题,辨析商标的使用和符号的使用,提出商标标识合理使用的概念;列举并探讨当今学者对合理使用所下之定义,明确合理使用的侵权抗辩地位。本文将商标标识的合理使用分为商业性合理使用和非商业性合理使用并进一步论述了本文着重探讨商业性合理使用的缘由。本文将商业性合理使用具体分为叙述性使用、指示性使用和比较广告三种类型。 第二部分探讨了商标标识合理使用的理论基础和实践背景。本文从商标本质要求、限制商标权、防止商标权滥用、促进市场竞争、保护消费者利益、完善商标立法体系和经济学意义角度对商标标识合理使用的理论基础进行了论证。揭示了商标标识合理使用的立法价值,说明了确立商标合理使用制度的合理性和必然性。 第三部分从叙述性使用、指示性使用和比较广告三种类型来进行具体的制度架构,通过分析国外的立法规定,着重探讨美国和欧盟的立法规定并结合相关典型案例来具体分析各自的构成要件,重点探讨混淆要件的适用,最后在对我国立法现状分析的基础上针对各个类型提出具体的立法建议。 第四部分介绍了网络环境下商标标识合理使用的新形势和新特点。网络环境下的合理使用判断原则上也应适用传统的合理使用要件分析,只是在具体判断时还应考虑商标标识不同使用形式的特殊性。本文从网页、网络关键词、域名、网络链接这几种商标标识使用方式入手来具体分析合理使用的认定标准,进一步探讨了初始兴趣混淆是否适用于我国,最后结合我国的立法现状提出立法建议。
[Abstract]:Starting with the problems existing in the system of rational use of trademarks, this paper probes into the theoretical basis and practical background of the system of rational use of trademarks, and discusses the rationality and inevitability of the system of rational use of trademarks. On the basis of clarifying the relevant basic concepts, correctly recognizing the rational use, combining with the design intention of the rational use system, the author reconstructs the rational use system, redefines its connotation, status and constitutive requirements. Straighten out the relationship between rational use and tort determination. Based on the analysis of the current situation of legislation in China, the author puts forward some specific legislative suggestions for different use types through the discussion of foreign advanced legislative provisions and typical cases, so that the reasonable use system of our country can be better applied in practice. Better balance the interests of trademark owners, other operators and consumers, settle disputes, and build a fair and orderly market order. The main content of this paper is divided into four parts: the first part reflects on the problems existing in the system of rational use of trademarks in China, discriminates the use of trademarks and the use of symbols, and puts forward the concept of rational use of trademark marks; This paper enumerates and discusses the definition of rational use and the position of tort defense. This paper divides the rational use of trademark into commercial reasonable use and non-commercial reasonable use, and further discusses the reason of commercial reasonable use. This paper divides commercial rational use into three types: narrative use, indicative use and comparative advertising. The second part discusses the theoretical basis and practical background of the rational use of trademark marks. In this paper, the theoretical basis for the rational use of trademark marks is demonstrated from the point of view of the essential requirements of trademark, the restriction of trademark rights, the prevention of trademark abuse, the promotion of market competition, the protection of consumer interests, the perfection of trademark legislative system and the economic significance. It reveals the legislative value of the rational use of trademark marks, and explains the rationality and inevitability of establishing the system of fair use of trademarks. The third part carries out a specific institutional framework from three types: narrative use, indicative use and comparative advertising. Through the analysis of the foreign legislative provisions, the emphasis is placed on the legislative provisions of the United States and the European Union, as well as the specific analysis of their respective constitutive requirements in combination with relevant typical cases, and the application of the confusion elements. Finally, on the basis of the analysis of the current situation of legislation in China, specific legislative suggestions are put forward for each type. The fourth part introduces the new situation and new characteristics of the rational use of trademark marks in the network environment. In principle, the rational use judgment under the network environment should also be applied to the analysis of traditional rational use elements, but the particularity of different use forms of trademark marks should also be taken into account in the concrete judgment. This paper starts with the use of web pages, network keywords, domain names and network links to analyze the identification standards of reasonable use, and further discusses whether the initial interest confusion is applicable in China. Finally, combined with the current situation of legislation in China, legislative suggestions are put forward.
