传播学的视角下看庭审口译中译员的主体性

【摘要】：近年来,随着我国与国外交流日益密切,涉外案件也逐渐增多。庭审口译的研究越来越受到重视。而庭审口译员经常被视为法律平等的“守门人”,因此促进庭审译员素质的提高,对于促进庭审效率以及保证司法公正都有着重要的意义。鉴于该领域在我国仍是一个新兴领域,并没有形成成熟、有体系的理论成果,研究如何提高庭审译员素质,并充分发挥其主体性,进而促进庭审效率不仅具有重大的必要性,而且有巨大的研究潜力。另外,本文作者具有丰富的庭审口译经验,在广泛实践中,作者深刻体会到,在庭审口译传播过程中,译员起着沟通媒介的重要作用,因此本文将研究重点放在了庭审口译中的译员主体性上。本文从一个全新的视角-传播学角度来研究庭审口译,并将重点放在庭审口译员的主体性上。将传播学经典模式-拉斯韦尔模式应用到庭审口译过程中,作者发现,口译员在传播过程中起着传播媒介的作用,操控着整个传播过程,对整体传播效果起着关键作用。因此,作者提出,传播过程口译这个交流媒介的作用得以凸显,在庭审口译中应充分发挥译员主体性。随后,作者在结合相关研究和总结自身广泛庭审实践的基础上,提出了关于实现和提升译员主体性的方法和建议。作者提出,译员主体性的实现条件有：译员能力建设、背景知识的准备、中立的临场心态、庭审实践经验的积累,而要提升译员主体性则可以从以下方面入手,如：灵活的临场应急处理、解释性语言的运用、译员素质与能力的规范、注重译员的职业道德。其中不乏作者的一些创见。以往庭审口译的研究多以总结相关理论为主,很少经过实践检验,缺乏实战性。本文引用作者亲自参与的真实的庭审口译案例,通过传播学的视角,审视译员主体性对于庭审口译实战的作用。从某种意义上说,这是对先前研究成果的一个有益补充。本文研究视角新颖,研究成果实用,作者真诚希望该论文研究成果能对庭审口译实践具有一定的指导和借鉴作用。
[Abstract]:In recent years, with the increasing exchanges between China and foreign countries, The study of court interpretation has been paid more and more attention to, and court interpreters are often regarded as "gatekeepers" who are equal to the law, thus promoting the improvement of the quality of court interpreters. In view of the fact that this field is still a new field in our country and has not yet formed a mature and systematic theoretical achievement, this paper studies how to improve the quality of court interpreters. In addition, the author has rich experience in court interpretation, and in the extensive practice, the author has a profound understanding of it. The interpreter plays an important role in the communication medium in the process of the trial interpretation, so this paper focuses on the translator's subjectivity in the trial interpretation. This paper focuses on the subjectivity of trial interpreters from a new perspective of communication. The author finds that the classical model of communication-Raswell model is applied to the process of trial interpretation. Interpreters play an important role in the process of communication, controlling the whole communication process and playing a key role in the whole communication effect. Therefore, the author proposes that the communication medium, interpretation, plays an important role in the communication process. The translator's subjectivity should be brought into full play in the trial interpretation. Then, on the basis of the relevant research and summary of his extensive trial practice, the author puts forward some methods and suggestions for realizing and promoting the translator's subjectivity. The author suggests that the conditions for the realization of the translator's subjectivity are: interpreter's capacity building. The preparation of background knowledge, neutral mentality, accumulation of experience in trial practice, and the promotion of interpreter subjectivity can be started from the following aspects, such as flexible emergency response, the use of explanatory language, The quality and ability of interpreters should be standardized, and the professional ethics of interpreters should be emphasized. In the past, the study of trial interpretation mainly focused on summing up the relevant theories, and was seldom tested by practice, lacking of actual combat. This paper cites the real trial interpretation cases in which the author personally participated, and through the perspective of communication, This paper examines the role of translator subjectivity in trial interpretation. In a sense, it is a useful supplement to the previous research results. The author sincerely hopes that the results of this paper can be used as a guide and reference to the practice of trial interpretation.
