追续权制度的法律研究

【摘要】:自法国在1920年将追续权纳入法律体系后,欧洲各国也陆续将之立法这一权利虽然在各个国家的法律实践中产生的效果不一,但是,这一权利的存在却表达了一种观点,即艺术家在著作权中的权利进一步增加了,法律对艺术家的保护范围扩大了这一权利给予了艺术家从已出售作品的转售中获利的权利,弥补了艺术家与作者以及作曲者在著作权方面存在差异的漏洞,也能有利于促进艺术家继续创作高质量的作品,推动艺术市场的繁荣 2012年12月30日,我国新闻出版总署向社会公众公布了著作权法修改草案(第三稿),在这一稿中确定了关于美术作品追续权的规定本文正是基于此背景,,通过介绍国外追续权制度的立法和实施情况,分析追续权制度在我国建立面临的困境,并提出相应的建议本文分为三个部分: 第一部分,追续权制度的概述本部分包括三章内容第一章介绍了本文的选题意义以及文献综述,第二章介绍了追续权的基本概念产生过程立法意义第三章从各国已有的法律规定中总结归纳了追续权的构成要件,并分析了不同法律规定的利弊 第二部分,追续权制度在国外的发展本部分主要是第四章的内容,介绍了追续权制度在国外的实施机制,如由著作权集体管理机构代艺术家与交易商对提取费的收取进合作,以及相同权利而产生的不同效果和相应的原因分析 第三部分,追续权制度在我国的建立本部分包括两章内容第五章介绍了在我国建立追续权制度面临的困境及其原因第六章针对上述困境对如何在我国建立追续权制度提出建议
[Abstract]:Since France incorporated the right of continuance into its legal system in 1920, European countries have successively legislated this right, although the effect of the right has been different in the legal practice of each country, but the existence of this right has expressed a kind of view. That is, the rights of the artist in the copyright have been further increased, and the legal protection of the artist has expanded this right to give the artist the right to profit from the resale of the work sold, It can make up the gaps in copyright between artists and writers and composers, promote artists to continue to create high-quality works, and promote the prosperity of the art market. In December 30th 2012, the General Administration of Press and publication of our country published to the public the revised draft of the copyright Law (the third draft), in which the provisions on the right to the continuation of works of fine arts were determined. This article is based on this background. By introducing the legislation and implementation of the foreign system of the right to pursue the continuation, this paper analyzes the difficulties faced by the establishment of the system of the right of follow-up in China, and puts forward corresponding suggestions. This paper is divided into three parts:. The first part, the summary of the system of the right of continuation, this part includes three chapters. The first chapter introduces the significance of the topic and the literature review. Chapter two introduces the basic concept of the right of follow-up and the legislative significance of the process. Chapter three summarizes and summarizes the constitutive elements of the right of follow-up from the existing laws and regulations of various countries, and analyzes the advantages and disadvantages of different legal provisions. The second part, the development of the continuation right system in foreign countries. This part is mainly about the content of chapter 4th. It introduces the implementation mechanism of the system in foreign countries, such as the collection and cooperation of the collection fee by the collective management agency of copyright on behalf of the artist and the dealer. And the different effects of the same rights and the corresponding reasons. The third part, the establishment of the system of the right of follow-up in our country, this part includes two chapters: chapter 5th introduces the difficulties and reasons of establishing the system of the right of follow-up in our country, and chapter 6th puts forward some suggestions on how to establish the system of the right of follow-up in our country in view of the above difficulties
