从功能主义翻译理论看法律文书的翻译

　　随着全球化进程的加快和深入发展,中国的经济和文化在过去的三十年中对全球其他地区的影响也不断扩大。在国际经济活动中,中国和外国在法律领域的交流在逐步增多。因此,法律文书的翻译在方便中外交流中贡献巨大。可以说,经济活动中利益的得与失在很大程度上依赖于相关法律文书翻译的正确与否。然而,给出一个完全令人满意的翻译对法律文书的译者来说并非易事,因为法律文书翻译涉及到三个学术领域:法学,语言学和翻译学,掌握此三领域难上加难。这就造成法律文书翻译质和量远远落后于其实际需求。目前,国内外许多翻译家和法律专业人士均专注于此领域的研究并提出了很多具有建设意义的原则和方法。但是如果我们阅读他们的研究成果就会发现两个问题:一个是关于研究对象的。过去的研究者们大多集中于在法律文书的微观层面进行研究,如对法律术语和法律文书句法的分析和翻译。在这种情况下,微观层面的对等被反复强调而文本功能却被忽视。另一个问题是关于建立研究体系的。法律文书翻译的研究现状表明目前的研究缺乏体系性。研究者们集中精力于法律文字及如何最大限度的保持其意义,从而忽略了建立一个包含定义,分类和方法论的完整研究体系。这种不全面的研究角度导致了法律...
