异化与回归：中小学教师惩戒权研究

【摘要】：在学校教育过程中,教师有管理和指导学生的权利。对于学生的失范行为,在劝诫不奏效的情况下,教师可以选择惩戒的方式来教育管理学生。但是教师是否存在惩戒学生的权利、教师拥有怎样的惩戒权、不同国家教师惩戒权的行使有无差异?本研究从上述问题入手,对教师惩戒权行使的理论和实践研究进行梳理,通过问卷和访谈调查的研究方法,探索我国中小学教师惩戒权在认识、方式、频率、阻力及效果上的使用现状。并通过比较研究的方法探析国外教师惩戒权行使的经验教训及对我国的启示。在此基础上发现我国中小学教师惩戒权行使异化存在“滥用”和“缺失”两种情况,同时政策法律、管理机制以及文化教育方面产生的问题也是我国教师惩戒权行使实现规范化、合理化亟待解决的问题。
[Abstract]:In the process of school education, teachers have the right to manage and guide students.In the case of failure of persuasion, teachers can choose the way of discipline to educate and manage students.But does the teacher have the right to discipline the students, what kind of disciplinary power does the teacher have, and whether there are differences in the exercise of the right to discipline in different countries?This research begins with the above questions, combs the theoretical and practical research on the exercise of teachers' disciplinary power, and explores the understanding, mode and frequency of teachers' disciplinary power in primary and secondary schools through the research methods of questionnaire and interview investigation.Resistance and effectiveness of the use of the status quo.Through the method of comparative study, this paper probes into the experience and lessons of the exercise of foreign teachers' disciplinary power and its enlightenment to our country.On this basis, it is found that there are two kinds of cases of "abuse" and "lack" of dissimilation in the exercise of disciplinary power of primary and secondary school teachers in our country, as well as the policy and law.The problems arising from the management mechanism and culture and education are also the problems to be solved urgently in the exercise of teachers' disciplinary power in China.
