【摘要】:同工同酬是劳动法体系中的一项重要原则,我国现行法律规定,被派遣劳动者享有与用工单位的劳动者同工同酬的权利。劳务派遣中存在同工不同酬的问题不仅损害了被派遣劳动者的合法权益,也不利于我国劳务派遣制度的健康发展。如果不尽快采取有效措施解决这一问题,必然会对构建和谐稳定的劳动关系带来负面影响。被派遣劳动者迫于就业压力等原因,在由用工单位、劳务派遣单位和被派遣劳动者三方组合的劳动关系中处于非常明显的弱势地位,本文结合劳务派遣中被派遣劳动者同工同酬权利保护的特殊性,对保护被派遣劳动者享有同工同酬权的理论基础和法律依据进行了梳理;从被派遣劳动者的工资薪酬、保险福利、休息休假、经济补偿等方面分析被派遣劳动者同工同酬权保护的不足及其危害和成因;从劳动立法及司法、政府政策及行政监管、工会建设、劳动者自身等方面探究保护对策的完善:关键是提高司法精度有效落实法律规定的执行,使劳务派遣用工只能在临时性、辅助性、替代性的工作岗位上实施。地方政府应当加强对劳务派遣滥用的监管,使劳务派遣用工回归到劳动合同用工的补充形式上来。创新工会组织的组建及入会形式,以适应劳务派遣中被派遣劳动者“雇”与“用”相分离的特点,发挥工会组织对劳动者的保护作用。被派遣劳动者自身应当积极抱团采取维权行动,维护同工同酬的合法权益。
[Abstract]:Equal pay is an important principle of labor law system, China's current law, the dispatched workers labor units and workers enjoy equal pay for equal work. There are unequal pay labor problems not only harm the interests of the dispatched workers, is not conducive to the healthy development of labor dispatch in China. If not as soon as possible to take effective measures to solve this problem, will bring the negative influence on the construction of harmonious and stable labor relations. The reason for the dispatched workers under the pressure of employment, in the labor units, in a very vulnerable position of labor dispatching units and dispatched workers combination of three parties in the labor relations, combining with the particularity of the workers for the protection of the rights of dispatched, in the theoretical and legal basis for the protection of the right to enjoy equal pay for the dispatched workers Out from the dispatched workers; salary, insurance and welfare, rest and vacation, analysis of the lack of dispatched workers equal pay for equal rights protection and its harm and causes of economic compensation and other aspects; from the labor legislation and judicial construction, government policy and administrative supervision, labor unions, etc. its inquiry protection measures: the key is perfect to improve the accuracy of the effective implementation of judicial law enforcement, the labor dispatch can only be temporary, auxiliary, the implementation of substitute jobs. The local government should strengthen the supervision of the abuse of labor dispatch, the labor dispatch return to the supplementary form of labor contract. The establishment and innovation of trade union organization membership form in order to adapt to the characteristics of the labor dispatch, the dispatched workers "hire" separation and "use", play a protective role of trade unions of workers dispatched laborers. The activist should actively take action to maintain the legitimate rights and interests of equal pay for equal work.
