WTO劳工标准问题与中国劳动法制的完善

【摘要】:劳工问题是当今世界面临的牵涉面最广的重大问题之一。在贸易自由化的背景下,劳工标准与贸易交织在一起,正日益受到多种角度的关注。WTO作为协调不同国家之间贸易规则的全球性组织,劳工标准问题被认为是对其在未来发展的挑战之一。尽管各成员立场各不相同,但劳工标准纳入WTO也有其合理性,已是大势所趋。本文在介绍劳工标准的基础上,围绕劳工标准与国际贸易的关系、劳工标准与WTO的关系、中国劳动法制的完善三个问题展开论述,并提出相关的看法与建议。 本文分为四章,第一章给出劳工标准的定义,从其渊源以及意义分析说明劳工标准;第二章分析劳工标准与国际贸易之间的冲突与协调关系,各国利益的差异与博弈;第三章回顾WTO劳工标准问题的历史进程,从WTO的权限、WTO体系外贸易与劳工的联系以及WTO规则的制定三方面分析,指出劳工标准纳入WTO是大势所趋;从经济全球化、国际劳工组织的不足以及发达国家和发展中国家在劳工问题上存在着共同利益三方面分析,指出劳工标准纳入WTO有其合理性;最后还对劳工标准纳入WTO提出几点看法;第四章在前三章的基础上,指出我国劳动法应适应劳工标准的要求,有所回应,应对劳动法制进行完善,加强我国劳动法对劳动者的保护,包括完善劳动立法,加强执法力度,改进对劳动者权益的法律救济措施等。
[Abstract]:In the context of trade liberalization, labor standards are intertwined with trade. WTO is being paid more and more attention from many angles. WTO is a global organization to coordinate the trade rules between different countries. The issue of labor standards is considered to be one of the challenges to its future development. Although the positions of different members are different, it is reasonable for labour standards to be incorporated into WTO. Based on the introduction of labor standards, this paper discusses the relationship between labor standards and international trade, the relationship between labor standards and WTO, and the perfection of China's labor legal system. And put forward the relevant views and suggestions. This paper is divided into four chapters. The first chapter gives the definition of labor standard and explains the labor standard from its origin and meaning. The second chapter analyzes the conflict and coordination between labor standards and international trade, the differences of national interests and the game. The third chapter reviews the historical process of WTO labor standards, and analyzes the relationship between trade and labor outside the WTO system and the establishment of WTO rules. It is pointed out that the integration of labor standards into WTO is the trend of the times. From the aspects of economic globalization, the shortcomings of ILO and the common interests of developed and developing countries in labor issues, the author points out that it is reasonable for labor standards to be incorporated into WTO. Finally, this paper puts forward some views on the integration of labor standards into WTO. On the basis of the first three chapters, Chapter 4th points out that China's labor law should meet the requirements of labor standards, respond to it, improve the labor legal system, and strengthen the protection of labor law, including the improvement of labor legislation. Strengthen law enforcement and improve legal remedies for workers' rights and interests.
