无就业证之外籍劳工劳动保护问题研究

【摘要】:在社会法理念盛行的二十一世纪,对无就业证之外籍劳工奉行十九世纪之古典合同主义不禁引人深思。将未取得就业证之外籍在华劳工全然排除在劳动法保护范围之外,有违法律公平之价值,有损保护人权之宗旨以及我国国际社会形象,且恐致使外籍劳工非正规渠道就业现象非正常繁荣。立足基本国情,借鉴欧美经验可知:对无就业证之外籍劳工提供一定程度之基础性劳动保护不仅有助于法律公平价值之实现,有助于保障外籍劳工的基本人权,还有利于缓解我国的"三非"问题。
[Abstract]:In 21th century, when the idea of social law prevailed. The application of the classical contract doctrine of 19th century to the foreign workers without employment permits is thought-provoking. It is against the value of legal fairness to completely exclude foreign workers who have not obtained employment permits from the scope of labor law protection. It is harmful to the purpose of protecting human rights and to the image of the international community of China, and it may lead to the abnormal prosperity of the employment of foreign workers in the informal channels, which is based on the basic national conditions. Draw lessons from the experience of Europe and the United States: to provide a certain degree of basic labor protection for foreign workers without employment permits is not only conducive to the realization of the value of legal equity, but also helps to protect the basic human rights of foreign workers. It is also conducive to alleviating the "three non-government" problems in China.
