论女性平等就业权的立法保护

【摘要】: 两性就业机会不均等、竞争不公平是当前女性就业求职过程中遇到的最主要问题。女大学生就业难已成为当今社会的焦点问题。根据调查表明,大学女生的综合素质并不差于男生,然而,在参与人才市场竞争时,很多用人单位却只愿意选择男性大学生,并在招聘启事上公然声称只要男性。此外,女性在就业市场遭受的不公平待遇还体现在收入、升迁和职业培训等方面。虽然现实就业过程中存在如此多的性别歧视现象,女性受害者却难以寻求到充分的法律救济途径。这就体现出我国现行保护女性平等就业权的法律制度存在着不容忽视的缺陷。因此,如何认识女性在就业中所面临的性别歧视?如何通过相应的立法措施来防止不平等现象的扩大?这些都是值得人们深思的问题。 平等权是公民享有的一项基本权利。文章以女性平等就业权的立法保护为研究对象,从女性平等就业权的内涵入手,首先介绍了国内外有关反对就业性别歧视法律制度的立法概况,通过分析目前我国女性就业的现状,对就业过程中女性遭受性别歧视的原因进行了剖析,最后结合我国目前的立法状况,提出当前女性平等就业权立法保护的原则,并对立法环节中的技术性难题进行了探讨,以期构建较为完善的女性平等就业权立法保护框架。
[Abstract]:Unequal employment opportunities and unfair competition between the two sexes are the most important problems in the process of women seeking employment. The employment difficulties of female college students have become the focus of the society. According to the survey, The overall quality of college girls is not inferior to that of men. However, when they compete in the job market, many employers are willing to choose only male college students and openly claim that they only want men in their job advertisements. Unfair treatment of women in the job market is also reflected in income, promotion and vocational training. Although there are so many sexist phenomena in the actual employment process, However, it is difficult for female victims to seek adequate legal remedies. This shows that the current legal system of protecting women's equal right to employment has defects that can not be ignored. Therefore, how to understand the gender discrimination that women face in employment? How to prevent the widening of inequality through corresponding legislative measures? These are all questions worth pondering over. The right to equality is a basic right enjoyed by citizens. This article takes the legislative protection of women's equal employment right as the object of study, starting with the connotation of women's equal employment right. First of all, it introduces the domestic and foreign legislation on the legal system against gender discrimination in employment, analyzes the current situation of female employment in our country, and analyzes the reasons why women suffer from gender discrimination in the process of employment. Finally, combined with the current legislative situation of our country, this paper puts forward the principles of the legislative protection of women's equal employment right, and probes into the technical problems in the legislative links in order to construct a more perfect legislative protection framework for women's equal employment rights.
