失业保险制度与其就业促进功能研究

【摘要】：失业保险是社会保险中的一项重要制度,它是指对非因本人意愿失业而暂时中断生活来源的劳动者提供物质帮助的制度。失业保险制度的两大基本功能是保障失业人员基本生活和促进就业。而在立法和实践中,由于价值取向、资源限制以及立法角度的不同及具体实施上的偏差,往往难以同时实现失业保险法律制度的两大功能,或是倾向于生活保障导向型,或是倾向于就业促进导向型。合理的失业保险制度可以有效的促进就业,不合理的失业保险制度则会对促进就业造成阻碍。保障失业人员维持基本生活只是失业保障制度的一个方面,仅为权宜之计,促进失业者再次就业,使其通过劳动获得安定的生活和个人的尊严才是失业保险制度的根本目标。我国的失业保险制度在制定之初,由于经济体制的局限和经济发展水平的制约,其更侧重于保障失业人员的基本生活,而在促进失业者再就业的方面,缺乏对就业促进功能的合理设计与妥善安排。我国目前不容乐观的就业形势和日益严峻的失业危机以及失业保险法律制度就业促进功能的不足要求我们在就业促进理念下重新思考我们的失业保险制度。
[Abstract]:Unemployment insurance is an important system in social insurance. It refers to the system of providing material help to workers who are not willing to lose their jobs and temporarily interrupt their sources of life.The two basic functions of the unemployment insurance system are to protect the basic life of the unemployed and to promote employment.In legislation and practice, it is difficult to realize the two functions of the legal system of unemployment insurance at the same time because of the value orientation, the limitation of resources, the difference of legislative angle and the deviation of concrete implementation.Or tend to be job-promoting-oriented.Reasonable unemployment insurance system can effectively promote employment, and unreasonable unemployment insurance system will hinder employment promotion.It is only an aspect of the unemployment security system to ensure the unemployed to maintain a basic life. It is only for the sake of expediency that the unemployed can be promoted to obtain employment again and to obtain a stable life and personal dignity through labor is the fundamental goal of the unemployment insurance system.At the beginning of our country's unemployment insurance system, because of the limitation of the economic system and the restriction of the economic development level, it focused more on the protection of the basic life of the unemployed people, and on the aspect of promoting the unemployed to re-obtain employment.Lack of reasonable design and proper arrangement of employment promotion function.At present, the employment situation and the increasingly severe unemployment crisis in our country, as well as the insufficiency of the employment promotion function of the legal system of unemployment insurance, require us to rethink our unemployment insurance system under the concept of employment promotion.
