【摘要】:正案情简介刘某2001年1月1日被某皮塑公司招录。2011年1月1日,公司考虑刘某在本单位工作已满10年,依法与其签订了无固定期限劳动合同。2011年3月,刘某在工作中不慎受伤,医疗期结束后作了工伤认定和伤残鉴定,伤残等级为七级。2011年8月初,刘某向公司表示不解除劳动关系,伤好后再回公司上班。8月底,刘某领取了一次性伤残补助金。2012年9月10日,公司发出书面通知,要求刘某回公司上班,刘某以伤势未痊愈不能胜任工
[Abstract]:On January 1, 2011, the company considered that Liu had already worked in his unit for 10 years and signed a labor contract with no fixed term according to law. In March 2011, Liu was accidentally injured in his work.After the end of the medical treatment period, he made the industrial injury identification and disability appraisal, and the disability grade was seven grades. In early August 2011, Liu Mou said to the company that he would not lift the labor relations, and returned to the company at the end of 8 months after the injury.Liu Mou received a one-time disability benefit. On September 10, 2012, the company issued a written notice requesting Liu to return to the company to work.
