试论用人单位解雇事由的法律规制

【摘要】:随着经济体制改革的不断深入,社会各阶层的经济利益发生着剧烈的分化和重组。就劳动法方向而言,劳方与资方的利益冲突表现得最为明显。劳动者在与用人单位的关系中处于劣势地位,虽然我国现在已建立了一套相关的劳动法规,,但是仍然不完善,对劳动者解雇保护的规定存在着一定的矛盾与空白之处。我们始终坚持对劳动者实行“倾斜保护”的原则,但对于用人单位而言,它们是市场经济投资的主体,在保护好劳动者利益的同时,又要不损害用人单位的投资积极性,这就需要我们充分考虑劳资利益的平衡。从实体着手,解雇事由是解雇保护中最严格的部分,也是离职管理最重要的部分。解雇事由在实际运用中,规定的不明确与欠缺影响着解雇纠纷的解决。我们要对劳动者被解雇的事由投入更多的关注,以此更好地维护劳动者的合法权益。
[Abstract]:With the deepening of economic system reform, the economic interests of all social strata have been sharply divided and reorganized. As far as the direction of labor law is concerned, conflicts of interest between labour and management are most obvious. The laborer is in the inferior position in the relation with the employing unit. Although our country has established a set of related labor laws and regulations now, it is still imperfect, and there are some contradictions and gaps in the regulations on the protection of the worker's dismissal. We have always adhered to the principle of "preferential protection" for the laborer, but for the employing units, they are the main body of investment in the market economy. While protecting the interests of the workers well, we should not harm the investment enthusiasm of the employing units. This requires us to take full account of the balance between the interests of labor and capital. From the entity point of view, dismissal is the strictest part of termination protection and the most important part of separation management. In practice, the ambiguity and lack of stipulation affect the settlement of dismissal dispute. We should pay more attention to the dismissal of workers so as to better protect the legitimate rights and interests of workers.
