论我国劳动就业权及法律保护问题

【摘要】:劳动就业权是人生存和发展的基本保障,劳动报酬是劳动者基本的生活来源,而在当今社会,就业形势严峻的情况下,劳动力资源是丰富,而工作岗位却是有限的,因此在这样的就业压力下,劳动者为了饭碗,为了生存,有时不能不选择放弃自己部分的劳动权益,这样的放弃是不得已的,而不是出于劳动者的真实意思表示,同时,,亦有很多企业利用劳动者急于求职的心理,任意的压低工作报酬,不与劳动者签订劳动合同等,劳动者稍有不服,就拿解除劳动关系作为威胁,因此,如何完善我国劳动权的实现机制就成为了现阶段劳动权保护的重点。我国虽然颁布了《就业促进法》,《劳动法》和《劳动合同法》予以保护劳动者的权益,但当前这些法律法规都存在规定过于宽泛和原则化、法律责任规定不具体、操作性不强等不足,因此,我国应在现有法律的基础上对劳动权的保护进行细化,明晰职业特殊情形所导致的就业区别,防止在就业过程中使劳动者的平等就业权受到侵害,同时,应加强对劳动权保护的执法力度,有关行政部门应尽到监督管理的责任,通过惩罚机制督促用人单位自觉主动地维护劳动者的权益,如对用人单位是否与劳动者签订劳动合同进行定期与不定期的排查,对用人单位的工作条件进行检查,有效的监督用人单位对劳动报酬的按时发放等,通过各种有效的实现机制使法律不成为空中楼阁,真正的保护到劳动者的合法权益,使得劳动者的基本人权得到保障。
[Abstract]:The right to employment is the basic guarantee for the survival and development of human beings, and the remuneration for labor is the basic source of livelihood of the workers. In today's society, the employment situation is grim, the labor resources are abundant, but the jobs are limited. Therefore, under such pressure of employment, workers sometimes have to give up some of their labour rights and interests in order to have a job and to survive. This kind of abandonment is a last resort, not because of the real intention of the laborer, and at the same time, There are also many enterprises that take advantage of the mentality of workers eager to find jobs, arbitrarily depress their remuneration for work, do not sign labor contracts with workers, and so on. When workers are slightly dissatisfied, they take the lifting of labor relations as a threat. Therefore, How to perfect the realization mechanism of labor right in our country has become the focal point of labor right protection at present. Although China has promulgated "Employment Promotion Law", "Labor Law" and "Labor contract Law" to protect the rights and interests of workers, but at present these laws and regulations are too broad and principle, legal liability provisions are not specific. Therefore, on the basis of the existing laws, our country should refine the protection of labor rights, clarify the employment differences caused by the special circumstances of occupation, and prevent the workers' equal employment rights from being infringed in the process of employment. At the same time, the enforcement of the law on the protection of labour rights should be strengthened, and the relevant administrative departments should exercise the responsibility of supervision and management, and urge the employing units to take the initiative to safeguard the rights and interests of workers through the punishment mechanism. For example, checking whether the employer has signed a labor contract with the laborer on a regular or irregular basis, checking the working conditions of the employer, and effectively supervising the timely payment of labor remuneration by the employer, etc. Through all kinds of effective realization mechanism, the law does not become a castle in the air, it really protects the legitimate rights and interests of the laborer, and makes the basic human rights of the laborer guaranteed.
