农地经营权抵押规则研究

【摘要】:对于普通农民而言,土地是其基本的生产生活资料。对于国家而言,经济发展离不开农业提供的物质基础。从2014年“中央一号文件”首次提出允许承包土地的经营权抵押融资起,国家从政策层面实现了对立法禁止耕地经营权抵押的突破。由于农地经营权抵押流转还处在试点阶段,目前缺乏针对农地抵押具体机制设计的研究。当前,农地经营权抵押规则并不能被一般的不动产抵押规则所函括,其在抵押主体、客体、设定及实现方式等诸多方面具有特殊性。如何使农地经营权抵押在法律上有规范表述是目前我们探讨的重点。所以,农地经营权抵押规则的研究具有重要意义。本文除前言和结语以外,主要分三个部分进行论述。第一部分主要介绍了农地经营权及抵押的相关概念的界定,就农地经营权的内涵及农地经营权抵押的特殊性分析。通过梳理文献及试点经验,确定农地经营权的内涵。此外,本部分对农地经营权的性质作出界定,承认其物权性质,为后文的农地经营权抵押规则构建奠定基础。第二部分主要介绍农地经营权抵押权的设立规则与设立限制,在梳理司法判例的基础上,从规范角度将实践中的纠纷涵盖,通过对农地经营权抵押的内部法律关系予以梳理,对农地经营权抵押主体作出分类并对其特殊权利义务予以分析,寻求抵押主体之间利益的平衡。对农地经营权抵押标的范围的分析,明确农地经营权抵押标的仅为农地经营权。农地经营权抵押权登记采登记生效模式,并肯定类推适用在抵押登记中的有限应用。第三部分主要介绍农地经营权抵押权的实现规则。本文在传统不动产抵押权实现条件基础上加入了农业经营企业破产时的实现条件。实现方式方面,农地经营权抵押权的实现分为一般实现方式和特殊实现方式,根据农地经营权的特性,提出农地经营权抵押权实现时应强化实现担保物权特殊程序的作用,并发挥强制管理的优越性。
[Abstract]:For ordinary farmers, land is their basic means of livelihood. Economic development can not be separated from the material basis provided by agriculture. Since 2014, the "No. 1 document of the Central Committee" has proposed for the first time to allow mortgage financing of the management right of contracted land. From the policy level, the government has realized the breakthrough of the legislation prohibiting the mortgage of the farmland management right. Because the circulation of the farmland management right mortgage is still in the pilot stage, there is a lack of research on the design of the specific mechanism of the farmland mortgage at present. The mortgage rules of farmland management right can not be included in the general rules of real estate mortgage, but in the subject and object of the mortgage. Such aspects as setting and realizing way have particularity. How to make the farmland management right mortgage in the legal standard expression is the focal point that we discuss at present. In addition to the foreword and conclusion, this paper mainly discusses three parts. The first part mainly introduces the definition of the related concepts of farmland management right and mortgage. Through combing the literature and experimental experience, the connotation of farmland management right is determined. In addition, this part defines the nature of farmland management right. The second part mainly introduces the establishment of the rules and limitations of the establishment of the mortgage on the management of agricultural land, on the basis of combing the judicial precedents. From the normative point of view, the disputes in practice will be covered, through the collation of the internal legal relationship of the right to the management of agricultural land mortgage to sort out the subject of the right to manage agricultural land mortgage and its special rights and obligations to be analyzed. To seek the balance of interests between the subject of mortgage. To analyze the scope of the subject matter of the mortgage of the right to manage agricultural land, make clear that the subject matter of mortgage of the right of management of agricultural land is only the right of management of agricultural land. The third part mainly introduces the realization rules of the mortgage of farmland management right. This paper adds the bankruptcy of the agricultural management enterprise on the basis of the realization condition of the traditional real estate mortgage. Implementation conditions and implementation methods. The realization of the mortgage of farmland management right can be divided into general realization mode and special realization mode. According to the characteristics of farmland management right, this paper puts forward that the special procedure of realizing security right should be strengthened when realizing the mortgage of farmland management right. And give play to the superiority of compulsory management.
