第三人致提供劳务者受害案件责任承担初探

【摘要】:《中华人民共和国侵权责任法》自2010年起正式实施,相应的《民事案由规定》也将提供劳务者受害责任纠纷替代雇员受害责任纠纷。由于没有出台《侵权责任法》司法解释,且其规定与《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》的规定不一致甚至冲突,导致在司法实践中大量个人劳务纠纷,特别是第三人致害的复杂案件难以得到统一的法律解读及责任认定。本文通过几则典型的第三人致提供劳务者受害案件的司法案例,提出研究主题——接受劳务者和第三人的责任承担问题。全文分为四部分:第一部分是问题的提出,指出在现行法律的规定下,该类案件审判实践中主要存在责任认定方面的问题,有仍沿用旧法适用无过错责任原则、片面理解新法过错原则只考虑提供劳务者单方过错以及扩大适用雇员选择权、雇主追偿权等情形。第二部分概述确定该类案件责任的前提条件,从法律关系上来说,该类案件的受案范围应属于有偿的个人劳务关系,雇佣关系作为劳务关系的上位概念其区分及认定不是案件审理的重点;从事实的认定上来说,提供劳务者受害事实需要同时具备时间、空间及因果关联性三要素。第三部分是本文的主要部分,着重讨论责任承担问题,从理论基础、归责原则到责任分配三方面确定接受劳务者与第三人之间应以过错责任为原则相互独立地各自承担相应责任;第四部分是本文的结论,笔者在以上理论基础上进一步拟出的司法解释建议稿。全文尝试重新解读第三人致提供劳务者受害案件,明确接受劳务者与第三人相互独立的责任关系,希望文章能够为该类案件的立法解释、司法指导作出可资参照的浅见。
[Abstract]:The Law of the people's Republic of China on Tort liability has been in force since 2010. The corresponding provisions on Civil cases will also replace the disputes over the victimization liability of employees by the disputes on the victimization liability of the providers of labor services, as there is no judicial interpretation of the Tort liability Law. And its provisions and the Supreme people's Court on the trial of personal injury compensation cases applicable to the interpretation of a number of legal issues inconsistent or even conflicting, resulting in a large number of personal labor disputes in judicial practice. Especially the complex cases caused by the third party are difficult to get a unified legal interpretation and responsibility. The thesis is divided into four parts: the first part is the raising of the problem, pointing out the provisions of the current law. This kind of case trial practice mainly exists the responsibility confirmation aspect question, some still uses the old law to apply the principle of no-fault liability. The one-sided understanding of the new law fault principle only considers the unilateral fault of the provider and the extension of the application of the employee's option, the employer's right of recourse. The second part outlines the preconditions for determining the liability of this kind of cases. In terms of legal relations, the scope of accepting cases should belong to paid personal labor relations. As the upper concept of labor relations, the distinction and determination of employment relations is not the focus of the trial. From the point of view of the facts, the victim facts of labor providers need to have three elements of time, space and causality at the same time. The third part is the main part of this paper, focusing on the issue of responsibility, from the theoretical basis. From the principle of liability to the distribution of responsibility, it is determined that the fault liability should be taken as the principle between the recipient and the third party to bear the corresponding responsibility independently. Part 4th is the conclusion of this paper, the author based on the above theoretical basis of further judicial interpretation of the proposed draft. The full text attempts to reinterpret the third party to the victim of labor cases. It is hoped that the article can provide a reference for the legislative interpretation and judicial guidance of this kind of cases.
