【摘要】：一直以来,个人信息利用行为与人格权保护行为存在微妙的关系,引发了许多法律问题,但并未受到法律的足够重视。然而,社会逐渐向信息化社会发展,促使个人信息的价值日益得以体现。在此过程中,人们在享受个人信息利用所带来的便利的同时,也深刻地感受着因此所带来的对人格权的限制。因此,研究个人信息利用与人格权保护的冲突与协调十分有必要。本文围绕个人信息利用与人格权保护的冲突展开,通过分析冲突的根源,并借鉴其他发达国家的经验及规范,力图寻求个人信息利用与人格权保护的平衡点。第一章是对个人信息利用与人格权保护的概述,在确定个人信息的概念的基础上概括其性质,并对个人信息利用的具体范畴进行了深入的分析,明确了个人信息利用与人格权保护之间的既有交叉又有矛盾的关系。第二章分析个人信息利用与人格权保护的冲突。该部分通过对个人信息利用的冲突的两种方式,即利益冲突与权利冲突,并通过对于个人信息利用中的两种冲突所包含的内容进行分析,充分的总结个人信息利用与人格权保护的冲突。第三章对其他国家个人信息利用的立法进行归纳并得出借鉴要点。通过深入总结各大国家个人信息利用的相关立法规范及法理依据,最终得出发达国家的相关法律对我国的借鉴之处。第四章通过对我国个人信息利用立法现状分析的基础上,并吸收从他国法律中所总结的优势要点,分别从理论和制度两方面提出个人信息利用法律制度完善的建议。
[Abstract]:All along, there is a subtle relationship between personal information use and personality right protection, which has caused many legal problems, but has not been paid enough attention by law. However, the society is gradually developing to the information society. The value of personal information is increasingly reflected. In this process, people enjoy the convenience brought about by the use of personal information, but also deeply feel the restrictions on personality rights brought about by it. It is necessary to study the conflict and coordination between personal information utilization and personality right protection. And draw lessons from the experience and norms of other developed countries, trying to find a balance between the use of personal information and the protection of personal rights. Chapter one is an overview of the use of personal information and the protection of personality rights. On the basis of defining the concept of personal information, it generalizes its nature, and makes a deep analysis of the specific categories of personal information utilization. The conflict between the use of personal information and the protection of personality right is analyzed in chapter 2.
