商标法对技术创新的推动

【摘要】：基于商标与技术在商品上的内在统一和商标法对商品内涵的关注,商标法对于技术创新可以发挥较大的作用;商标法的作用主要体现在增加技术创新的产出、推动创新技术的运用、提高技术服务水平、保障技术创新的成果等方面。商标法作用的发挥有赖于下列商标法律制度的合理设计和灵活运用:驰名商标的认定与保护,商标显著性的认定,连续不使用商标的撤销,注册商标的许可与转让,有一定影响商标的认定,商标侵权行为的处理等。
[Abstract]:Based on the inherent unity of trademark and technology in commodities and the concern of trademark law on the connotation of commodity, trademark law can play a greater role in technological innovation. The role of trademark law is to increase the output of technological innovation, promote the use of innovative technology, and improve the level of technical services. The role of trademark law depends on the rational design and flexible application of the following trademark legal system: the recognition and protection of well-known trademarks and the recognition of trademark significance. The revocation of the trademark without use, the license and transfer of the registered trademark will affect the determination of the trademark and the treatment of the trademark infringement.
