公众共用物的非排他性属性研究——基于经济学理论的适用及对传统私法的反思

【摘要】：非排他性属性在经济学物品属性分析中得到充分的研究并形成普遍适用的理论,参考并适用经济学中非排他性属性分析有助于理解公众共用物的非排他性。我国传统私法尤其在物权法中强调的是对物的排他性权利,而公众共用物的非排他性显然有别于物权法的规制与调整,并且其决定所适用的法律制度的构建具有特殊性。因此,非排他性属性作为公众共用物的根本属性,决定其不能笼统地适用现有的物权法律制度。
[Abstract]:Non-exclusive property has been fully studied in the property analysis of economic goods and formed a universally applicable theory. Referring to and applying the non-exclusive attribute analysis of economics is helpful to understand the non-exclusivity of public common objects. The traditional private law of our country emphasizes the exclusive rights of things, especially in the property law. However, the non-exclusiveness of public common objects is obviously different from the regulation and adjustment of property law, and the construction of the legal system applicable to its decision has its particularity. It is decided that the existing legal system of real right should not be applied in general.
