现货代购商标侵权与例外

【摘要】:网络海外代购分为消费者指示代购和现货代购,现货代购是主要的代购方式之一。按消费者指示代购具有委托代理性质,现货代购则是自营购销的买卖行为。现货代购是平行进口行为,可分为B2C现货代购和C2C现货代购。现货代购人不具有行纪商及代理人身份,而转变为自营购销的经销者。依据《商标法》第57条第1项、第3项及《侵权责任法》的相关规定,综合权衡商标权人、代购商的利益和社会公共利益,原则上应认定现货代购构成商标侵权。但是,现货代购存在侵权的例外:只要未造成消费者混淆且不损害国内商标权人的"独立商誉",则应在国内外商标权人为"相同所有人"或"共同控制"情况下承认现货代购的合法性。
[Abstract]:Online overseas purchasing is divided into consumer directed purchase and spot purchase, which is one of the main ways of purchasing goods. According to the instructions of consumers, it has the nature of entrustment and agency. Spot purchase is a self-owned purchase and sale behavior. Spot purchase is a parallel import act, which can be divided into B2C spot purchase and C2C spot purchase. The spot agent does not have the identity of broker or agent. In accordance with Article 57, item 1, item 3 of the Trademark Law and the relevant provisions of the Tort liability Law, the interests of the trademark owner, the agent purchaser and the public interest, In principle, it should be determined that spot purchase constitutes trademark infringement. However, There is an exception to the infringement of spot purchase: as long as the consumer is not confused and the "independent goodwill" of the domestic trademark owner is not damaged, it should be recognized if the trademark owner at home and abroad is the "same owner" or "joint control". The legitimacy of the purchase of goods on behalf of the goods.
