云计算下信息网络传播权侵权责任认定问题研究

【摘要】：云计算技术作为一项新兴的技术,对于信息产业的影响越来越大。随之而来的是不同于以往的信息网络传播权侵权模式和行为。面对这些新出现的问题,传统的法律已经无法进行彻底的规制,法律的滞后性导致的矛盾也愈发突出和激烈。正是基于这一现状,本文从云计算的定义与特点出发,试图对云计算服务下的信息网络传播权侵权责任认定问题进行讨论。首先,本文分别介绍了云计算及信息网络传播权的概念和特征。明确了云计算及信息网络传播权的概念和特征,有助于我们进一步讨论云计算下信息网络传播权的侵权责任认定问题。其次,对于云计算下信息网络传播权侵权责任认定的现状进行了分析。结合云计算的特点,分别对云计算服务用户侵权责任认定、云计算服务运营商侵权责任认定、云计算用户与运营商联合侵权责任认定问题进行了分析。在这些分析的基础上,引出了下文对云计算服务下信息网络传播权侵权责任认定存在的问题的讨论。再次,讨论了云计算下信息网络传播权侵权责任认定存在的问题：信息网络传播权侵权主体不明、信息网络传播权侵权责任认定标准不清、临时存储侵权责任认定观点存在分歧、软件出租侵权责任不明确。这些问题看似复杂,归根结底还是由于云计算的特殊性造成的。最后,针对云计算下信息网络传播权侵权责任认定存在的问题,在之前分析的基础上,提出了几点建议：明确云计算下信息网络传播权侵权主体,明确云计算下信息网络传播权侵权责任认定标准,明确云计算下临时存储侵权责任,明确云计算下软件出租侵权责任。希望这些建议能够对云计算环境下信息网络传播权的侵权责任认定问题有所帮助。
[Abstract]:Cloud computing technology, as a new technology, has more and more influence on the information industry. The traditional law has been unable to regulate thoroughly, and the contradiction caused by the lag of the law has become increasingly prominent and fierce. It is precisely based on this situation, this paper starts from the definition and characteristics of cloud computing. This paper attempts to discuss the problem of tort liability of information network communication right under cloud computing service. First of all, this paper introduces the concept and characteristics of cloud computing and information network communication right, and clarifies the concept and characteristics of cloud computing and information network communication right. It is helpful for us to further discuss the problem of tort liability of information network communication right under cloud computing. Secondly, this paper analyzes the status quo of tort liability of information network communication right under cloud computing. Combined with the characteristics of cloud computing, the author respectively determines the tort liability of cloud computing service users and cloud computing service operators. On the basis of these analysis, this paper leads to the discussion of the problems in the identification of tort liability of information network communication right under cloud computing service. Thirdly, the paper discusses the problems existing in the identification of tort liability of information network communication right under cloud computing: the subject of information network communication right infringement is unclear, and the standard of information network communication right tort liability determination is not clear. There are differences of opinion on tort liability of temporary storage and unclear liability of software rental tort. These problems seem to be complicated, but in the final analysis, they are caused by the particularity of cloud computing. Finally, aiming at the problems existing in the identification of tort liability of information network communication right under cloud computing, on the basis of previous analysis, this paper puts forward several suggestions: make clear the subject of infringing information network communication right under cloud computing. Define the standard of tort liability of information network communication right under cloud computing, clarify the tort liability of temporary storage under cloud computing, Make clear the tort liability of software rental under cloud computing. I hope these suggestions can help to identify the tort liability of information network communication right in cloud computing environment.
