论精神损害赔偿在民事审判中的具体适用

【摘要】：精神损害赔偿作为损害赔偿的一种方式,是一项重要的人权保护制度。近年来,随着我国法制进程的不断加快以及法制观念的逐渐树立及增强,索赔精神赔偿的案件数量大为增加,精神损害赔偿作为现代民事法律理论和实践的重要组成部分之一,更加为公众知晓,但随之带来的争议和矛盾也更多。对精神损害赔偿的深入研究体现出法治的进步和对人权的更加尊重,对建立我国完善的民事法律体系具有不可或缺的重要作用。应当说,我国的精神损害赔偿制度从无到有,直至上个世纪末已经基本建立起来,但是尚不完备。而存在的问题及产生的争议也在实践中暴露出来。纵观目前对于精神损害赔偿在民事审判中的具体适用上,仍存在诸多不完善的地方,甚至严重到很多时候法官对于该项赔偿的自由裁量权无法适用而采取回避的情形,这就到了亟待我们重新进行评估及加以改善的时候了。
[Abstract]:As a way of compensation for damages, mental damage compensation is an important system of human rights protection. In recent years, with the continuous acceleration of the legal process and the gradual establishment and enhancement of the concept of legal system in our country, As an important part of modern civil law theory and practice, compensation for spiritual damages has become more widely known to the public. However, there are more disputes and contradictions that come with it. The in-depth study of compensation for moral damage reflects the progress of the rule of law and greater respect for human rights, and plays an indispensable and important role in the establishment of a sound civil legal system in our country. The system of compensation for mental damage in our country has been basically established until the end of the last century. However, it is not complete yet. The existing problems and disputes are also exposed in practice. There are still many imperfections in the specific application of mental damage compensation in civil trials. It is even so serious that judges often avoid the possibility that the discretion of the compensation cannot be applied, and it is time for us to re-evaluate and improve it.
