城镇化进程中农村宅基地使用权法律制度研究

【摘要】：土地作为人类社会重要的生产资料和生活资料,发挥着巨大的作用。随着我国生产力的不断发展,社会主义市场经济体制的建立和完善,土地、劳动力、资本等生产要素由市场机制配置成为社会主义市场经济发展的现实要求。“三农”问题历来是党和政府工作的重心,而土地问题更是“三农”问题中的核心。土地一直是农民安身立命的根基,我国农村宅基地使用权制度就是建立在“居者有其屋”的社会保障理念基础之上。我国城镇化进程在稳步推进,在这个过程中农村宅基地使用权法律制度遇到了很多困境和障碍,特别是在宅基地使用与管理制度方面存在一系列的问题,对我国社会主义新农村建设,社会主义和谐社会的构建带来了消极影响。当前,完善宅基地制度已成为农村新时期土地改革中的重要组成部分。在农民所有的土地权利中,农村宅基地使用权作为重要的土地权利,这个权利处理的好坏将对其作用的发挥产生重大影响。正是基于上述认识和思考,将农村宅基地使用权作为研究对象,在城镇化的视阈下,研究宅基地使用权的历史沿革,探索其变化与城镇化的关联程度。论文共分为五个部分,首先是绪论部分,简单介绍国内外对宅基地使用权的研究现状;其次明确城镇化与农村宅基地使用权的界定,详细介绍我国城镇化的发展进程,以及农村宅基地使用权制度的变革;再次叙述我国城镇化进程中存在的问题进行深入剖析,并就产生问题的原因进行分析;然后结合具体案例,针对相关试点采取的做法,进行可行性分析;最后对城镇化进程中宅基地使用权的完善提出对策建议,分别从取得制度、流转制度、消灭制度以及相关配套措施等方面进行阐述。城镇化进程的步伐在不断加快,城市日趋扩大,政府或者开发商征收农村中大量闲置甚至使用中的土地,影响到农民最基本的宅基地使用权。一方面是城市房价的持续不断上涨,另一方面是屡禁不止的城郊小产权房交易,违法乱建房屋随处可见,而村庄外住宅却大量无序存在。因此,农村宅基地使用权制度的完善刻不容缓。
[Abstract]:As an important means of production and means of livelihood of human society, land plays a great role. With the continuous development of productive forces in China, the establishment and improvement of socialist market economic system, land, labor force, The allocation of capital and other factors of production has become the realistic requirement of the development of socialist market economy. The issue of "agriculture, countryside and farmers" has always been the focus of the work of the Party and the government. And the land issue is the core of the "three rural" issues. Land has always been the foundation for farmers to settle down. The system of rural homestead use right in China is based on the social security concept of "Home ownership", and the process of urbanization in China is advancing steadily. In this process, the legal system of the right to use the rural homestead has encountered many difficulties and obstacles, especially in the use and management of the homestead, there are a series of problems in the construction of the new socialist countryside in China. The construction of a harmonious socialist society has brought negative effects. At present, perfecting the homestead system has become an important part of the land reform in the new period of rural areas. As an important land right, the right to use the rural homestead will have a great impact on its function. It is based on the above understanding and thinking that the right to use the rural homestead is regarded as the object of study. From the perspective of urbanization, this paper studies the historical evolution of homestead use right and explores the relationship between the change and urbanization. The paper is divided into five parts, first of all, the introduction part, a brief introduction to the domestic and foreign research status of homestead use right; Secondly, the definition of urbanization and rural homestead use right is defined, and the development process of urbanization and the reform of rural homestead use right system are introduced in detail. And analysis of the causes of the problems; then combined with specific cases, in view of the relevant pilot practices, feasibility analysis; finally, the improvement of the use of residential land in the process of urbanization proposed countermeasures and suggestions, respectively from the acquisition system, The pace of urbanization is speeding up, the cities are expanding day by day, and the government or developers are expropriating a large number of unused or even used land in rural areas. Affecting the most basic homestead use right of farmers. On the one hand, the continuous rise in urban house prices, on the other hand, the repeated prohibition of small property rights in the suburbs, the illegal construction of houses everywhere. However, a large number of houses outside the village exist disorderly. Therefore, it is urgent to perfect the system of the right to use the rural homestead.
