论民法上和解合同的客体范围

【摘要】：民法上和解合同的客体范围对民法上和解合同制度的完善有着重要的意义,同时也是各国立法与学理中具有争议的一个问题。民法上和解合同的历史源流以及其与相似概念的辨析,论证了民法上和解合同以争执的存在为前提。权利实现与否不确定之情形对应的为明确的无争执的法律关系,防止争执发生之情形对应的为将来发生争执的法律关系,这两种情况都不应当纳入民法上和解合同的客体范围。民法上和解合同的客体范围应当为"终止争执"。此处的争执,一方面指当事人互为对立主张的法律关系之争执,另一方面指非法律关系直接对立但有争议而导致的法律关系不明确之情形。
[Abstract]:The object scope of the settlement contract in the civil law is of great significance to the perfection of the settlement contract system in the civil law. At the same time, it is also a controversial issue in the legislation and theory of various countries. It is demonstrated that in civil law, the existence of disputes is the premise of the settlement contract. The legal relationship corresponding to the uncertainty of the realization of rights is a clear and non-disputable legal relationship, and the one corresponding to the situation of preventing disputes is the legal relationship of future disputes. Neither of these two cases should be brought into the scope of the object of the settlement contract in the civil law. The object scope of the settlement contract in the civil law should be "terminating the dispute". On the other hand, the non-legal relationship is directly opposite but controversial and the legal relationship is not clear.
