网络虚拟财产法律保护问题探究

【摘要】：随着互联网技术日新月异的发展,网络虚拟财产这一随之应运而生的新事物越来越多的受到人们的关注。法律的滞后性和相关法律制度的缺失,导致网络虚拟财产相关纠纷越来越多。近年来,境外多国已比较明确承认了网络虚拟财产的法律地位。尽管我国刚刚通过的《民法总则》对网络虚拟财产权利客体地位予以了确认,但其过于概括,需要更加具体的法律制度予以落实。网络游戏产业规模已逾千亿,用户数以亿计,厘清网络虚拟财产归于何种法律保护范围和当事各方权利义务界定十分必要。纠纷高发态势与相关法律缺失矛盾日益凸显。围绕网络虚拟财产特征与和相关权利保护的问题,本文主要讨论网络虚拟财产的属性,我国网络虚拟财产立法现状和存在的问题,网络虚拟财产立法先行国家地区经验,并为完善我国网络虚拟财产保护提供建议。本文分为六章。第一章绪论介绍论文研究动因,国内外研究现状和本文研究思路。第二章是对网络虚拟财产的基础理论阐述,在这一章介绍网络虚拟财产的基本问题,包括网络虚拟财产的概念、由来、特点和存在范围。第三章讨论我国关于网络虚拟财产的现行规定和实践中存在的主要问题。包括网络虚拟财产权属不明、价值评估困难、案件的管辖权归属争议、速速成本高昂等。第四章介绍国外及台湾地区网络虚拟财产保护现状。主要介绍了韩国、美国和台湾地区的经验,从中提取对我国有用的经验。第五章分析网络虚拟财产的权利属性与归属,明确权利属性是对网络虚拟财产充分保护的前提。学界对网络虚拟财产的权利属性认识具有很大分歧,当前主要有知识产权说、物权说、债权说、新型财产权说和无形财产说。笔者支持将网络虚拟财产权利纳入无形财产权的观点,支持用户享有网络虚拟财产权利。第六章探讨网络虚拟财产法律保护机制,包括用户与第三方、运营商发生争议的情况和争议发生时的权利义务界定。为我国网络虚拟此案产保护提供一些具体建议,包括建立网络虚拟财产价值评估机制、小额程序适用、建立在线争议解决模式等。
[Abstract]:With the rapid development of Internet technology, people pay more and more attention to virtual property.The lag of law and the lack of relevant legal system lead to more and more disputes about network virtual property.In recent years, many foreign countries have recognized the legal status of network virtual property.Although the General principles of Civil Law just passed in our country confirm the object status of network virtual property right, it is too general and needs more concrete legal system to be implemented.The scale of the online game industry has exceeded 100 billion and the number of users is hundreds of millions. It is necessary to clarify the legal protection scope and the rights and obligations of the parties involved in the virtual property of the network.The contradiction between the high incidence of disputes and the lack of relevant laws is increasingly prominent.Focusing on the characteristics of network virtual property and the protection of related rights, this paper mainly discusses the property of network virtual property, the current situation and existing problems of our country's network virtual property legislation, and the national and regional experience of network virtual property legislation.It also provides suggestions for perfecting the protection of virtual property in our country.This paper is divided into six chapters.The first chapter introduces the research motivation, domestic and foreign research status and research ideas.The second chapter is the basic theory of the virtual property of the network. In this chapter, it introduces the basic problems of the virtual property of the network, including the concept, origin, characteristics and the scope of existence of the virtual property of the network.The third chapter discusses the current regulations and main problems in the practice of network virtual property in our country.Including the network virtual property rights are unknown, the value evaluation is difficult, the jurisdiction of the case belongs to the dispute, the speed cost is high and so on.The fourth chapter introduces the status of network virtual property protection in foreign countries and Taiwan.This paper introduces the experiences of Korea, America and Taiwan, and draws some useful experiences from them.The fifth chapter analyzes the attribute and attribution of the network virtual property, which is the premise of the full protection of the network virtual property.Scholars have different views on the property of network virtual property. At present, there are three main theories: intellectual property, real right, creditor's right, new property right and intangible property.The author supports the idea of bringing the virtual property rights into the intangible property rights, and supports the users to enjoy the virtual property rights.The sixth chapter discusses the legal protection mechanism of network virtual property, including users and third parties, the situation of disputes between operators and the definition of rights and obligations when disputes occur.It provides some concrete suggestions for the protection of network virtual case in our country, including setting up the evaluation mechanism of network virtual property value, the application of small amount of program, and the establishment of online dispute resolution model, etc.
