农村宅基地:由“生增死不减”到“增人不增地”

【摘要】:以"集体所有"、"一户一宅"、"权能限制"和"双划管理"为主要内容的我国宅基地使用权制度框架,不仅难以适应新时期农村人地关系现状,且抑制了农民的宅基地资产权利主张,也降低了农地资源的整体利用效率。为解决宅基地供求矛盾,我国宅基地制度变革应以开放宅基地的流动性置换农村集体经济组织的成员权,由"生增死不减"向"增人不增地"转变,由"一户一宅"向"一人一房"转变,由"无偿、无期限、限制流通"向"有偿、有期限、完全流通"转变,由分散居住、自建向集中居住、他建转变。
[Abstract]:With "collective ownership", "one house per family", "power restriction" and "double management" as the main contents of the system of homestead use right in China, it is not only difficult to adapt to the present situation of the relationship between people and land in rural areas in the new period.It also inhibits the claim of homestead property rights of farmers and reduces the overall utilization efficiency of agricultural land resources.In order to solve the contradiction between the supply and demand of the homestead, the reform of the Homestead system in our country should replace the membership right of the rural collective economic organization with the fluidity of the open homestead, and change from "increasing the life, increasing the death" to "increasing the person without increasing the land".From "one family, one house" to "one person, one house," from "free, unlimited, restricted circulation" to "paid, limited, complete circulation," from scattered living, self-building to centralized housing, he built a change.
